What happens if you get arrested for theft $50<$500 while on probation for Dwi?
My husband got put on 2 years probation after getting a DWI for xanax in his system it was a first offense. A week or 2 later he got jumped on from behind at Wal-Mart while he was in the garden area and had his sweater pulled off from over his head and ran from this person. When he got home he called the police station about it and come to find out it was one of those mystery shoppers and he was being charged with theft because there was an item with the sweater of his that was pulled off of him as well as his wallet with $200 in it and before he ran he dropped a flashlight he was holding. He had to turn himself in and bond out, a month later he was arrested for MTR and has been in jail for 25 days Has court in 2 days.
I am not licensed in Texas, so my answer should be considered with less weigh than that of an experienced criminal...
Is a 3rd dwi and evading in motor vehicle guaranteed time in jail? Or would something like over nights be possible? Tx

I am facing my third DUI. The first two were over 15 years ago but does not matter in Texas. It is a felony charge. I was stopped for doing 76 in a 70. No swerving, crossing lines, failure to maintain lane. I was driving because my girl had fallen ill. The officer noticed the smell of alcohol on me. He removed me from the car and I did the field tests including one foot counting to over 100 til the officer got tired of me NOT losing balance. I refused the breath test at the jail and was told a nurse would be down to draw blood. She never showed up between the time of booking and when I was bonded out. What are my chances of beating this charge? There is also video of the officer pouring out nearly the entire second beer which I had just opened before driving.
