How is it a legal arrest for driving under the influence if I'm not driving, not in or near my car.
Went to move my car after 2 shots of vodka. Parked car and went home, knew I was in for night and had big drink fast and went to restroom. I was arrested for a DUI in Colorado and refused the blood test. My license was taken by the officer and after requesting a hearing, I was given a 60 day temporary license. However, I am from another state and in looking at the application for a lost or stolen license from my home state, I do not see any question that I cannot answer truthfully, such as "Has your license been lost, stolen, or taken a law enforcement?" or "Is your privilege to drive currently suspended, cancelled, revoked or denied in this or any other state?"
