A little background. I was pulled over for a dui while i was already parked in a parking lot. After i pulled in i turned off my vehicle and put the keys in my passenger seat to make a phone call. About 1 minute later a police officer pulled in behind me and flipped on his lights. Keep in mind i was not driving. He treated it like a normal stop. I blew a .084. I was charged with a DUI of a BAC .084. It was determined that the stop was illegal in court and the evidence was suppressed. I pulled into a parking lot at which point a police officer pulled in about 1 min later and turned on his lights. The judge determined that the officer had no right to stop me since there was no crime being commited. Thusly all the charges have been dropped. However i have not heard from the DMV for 4 months now. I am aware that an APS will not just go away. How long does the DMV have to contact me for the APS and can i win it on those details.
