Currently involved in a DCF case due to a false report being made against me by (who I can assume) is the children's father. He was released from prison in Sept 2017 after being convicted of 2 felony counts of DUI w/ serious bodily injury. Statute 39.0138 states: "The department may not place a child with a person other than a parent if the criminal history records check reveals that the person has, within the previous 5 years, been convicted of a felony that falls within any of the following categories: (a)Assault; (b)Battery; or (c)A drug-related offense." Are the 2 felony counts of DUI w/ serious bodily injury considered a drug-related offense? If so, what should be filed to let the court know my children were placed with a felon which has be convicted of one of the felony's listed in Statute 39.0138? I was appointed an attorney who has been on vacation since the day this began in Sept. Her sub told me it is easier to move forward than to attempt to revisit topics already spoken about in court. I was never given the time of the shelter hearing, and therefore missed it. I can prove insufficient notice was given & am currently looking for a private attorney for my case.

I had just got a good full-time job in construction nearly 3 months ago. I do understand i had a whole year to get everything done, but there have been some hurdles to jump. My daughter was born 3 months into my probation. Me and my girlfriend live separate, so ive had to give her a certain amount a week. My mistake was i didnt do it in money order for proof. The second one is the fact that i had gotten my job so late. Im saving every cent i can, i have a small but decent amount, im enrolling in DUI school tomorrow. I was put on PTD for minor in possession of alcohol. I was never arrested just given a notice to appear in court. I have completed my community service hours, paid all the fees, and I got my evaluation done and the woman had told me that I tested within the lowest bracket and that I was in no way an alcoholic BUT she was still giving me 10 classes at $20 each instead of the substance abuse course. I didn't find this fair so I called my officer and she said I could go to one more place for an evaluation. That's all I have left to do but I was in the process of moving to a different city at the time (this was last month) and now am in the process of moving to another state and I have been traveling for the past 3 weeks. I was put onto a telephone reporting system and was prompted to take a drug test. I emailed my officer and asked if it was okay that I completed everything when I got to Texas and he said it was fine. He then called me a few days ago saying I have 30 minutes to take a test but I was on a plane at the time so I couldn't get it done and now I'm being revoked. I have the email saying I could complete the program after I move and don't understand why I'm being revoked
