Second dui with a refusal, received a letter saying I could get a restricted license but MAU said this was false???
Hi I received a second DUI about six months ago with a refusal, I just read a letter the DMV sent stating that I could receive a restricted license at any time, so I went to the DMV they told me to call MAU so I did and they said because it was a hard suspension due to the refusal and there was nothing I could do. But the letter stated that I could call for hearing, I was wondering if I could call a hearing and possibly get a restricted license as I was riding my bike to and from work and AA meetings averaging 35 miles a day something I was willing to do as I did drive when I was not supposed to, but now that winter has hit it is becoming difficult to hop on my bike at 5 in the morning and ride to work in the mountains up here. I have been officially sober for 8 month on the 22nd of this month and working to get my life back on track, the extra work I could get having a restricted license could seriously help with this and I hate having to be a hindrance on my boss having him come pick me up during the rainy days when I cannot ride. I showed up for my court date this morning, and found that the DA's office sent a memo stating "This office has read and considered the california highway patrol incident report number XXXXXX and is declining to file charges at this time in regards to the above mentioned report for said suspect." I am not sure exactly why and didn't really want to hound the DA office for details. I'd rather not remind them of the case if I don't have to. I noticed that the Memo was written only a couple of days after my arrest so I'm assuming they saw something in the report right away that discouraged them from filing charges? Hi, I got a dui about 5 years ago and 2 driving on a suspended licenses within the first year of my suspention. So basically i got 2 driving on a suspended license charges 4-5 years ago because of the dui. I was wondering how long it took for those to get off of your record so the dmv doesnt see them, or if i get another one the court with will see it as the first and not a third conviction. On October 2007 I was arrested on suspicion of DUI while on my way to Yosemite, CA jail to pick my wife up after having herself been arrested for DUI about 4-5 hours previously. After much harassment, I was coerced into submitting to a field sobriety test after which I was told I could pick up my wife only if I submitted to a breathalyzer test if "the numbers were right." I was also told that if I did not submit voluntarily, there was enough evidence to warrant my arrest. I asked questions for clarification, and before I had a chance to reply, I was arrested, and taken to jail after submitting to a mandatory blood test which subsequently showed by blood alcohol level to have been 0.0%. Since then, my DUI charges have been dropped, but the National Park Service continues to prosecute for a traffic violation such as running a stop sign or similar offense. Any arrest on my record can have seriously negative repercussions in my career whether justified or otherwise. Am I entitled to sue for false arrest DUI OVI, civil rights violations, false imprisonment, due process violation, etc? What rights were violated during the DUI stop? Can I initiate a civil case while the criminal case is ongoing? Is it possible to get the arrest off my record? Thank you for your attention and advice.

DUI: What do I do now?
OCTOBER 8,2017. I drove from LA in order to drop off my girlfriend for school in UCR around 3:30 AM. The last drink I had was at 10:00 PM and I was drinking a lot of water around 2:00 AM. I stopped on the 60 freeway to assess damage to wheels and take care of girlfriend feeling sick. 2 minutes later, 2 cops show up and ask me to step out the vehicle immediately as soon as they arrive. They ask me some questions and drive my car off the highway. There, they ask me to do a field sobriety test and blow into the breathalzyer. I had a .12 on the field breath but I had a second chemical test at the San Dimas Hospital for blood. They did not read my rights. I was later brought to the San Dimas police jail and was held for 15 hours. They gave me a pink slip, car tow information, and a citation to appear in court at December 19, 2017 at 8:00 AM. I work M-F on 9AM - 6PM in Encino as an accountant. It is the busy season right now for accountants and I have no time to fight this on my own. I live in Granada HIlls, CA. I also have to disclose I have 2 moving violations (U-turn and improper use of middle lane) from 7/31/2017 and 8/31/2017 that I was going to deal with after busy season.
