I have a felony because of 2 DUI's years ago. I just read about Illinois House Bill 2470 can this new bill help me expunge?
I spent time in jail. I am having a difficult time finding work.
HB 2470 does not appear to assist you. SYNOPSIS AS INTRODUCED: 20 ILCS 2630/5.2 Amends the Criminal...
If you have 2 DUI's from Michigan (2001 & 2002), & get pulled over for a DUI in IL with suspended license, is it a felony?
My boyfriend's license was suspended after 2 DUI's from MI in 2001 & 2002. He got pulled over with a BAC of .193 and doing 74 in a 40 in October of 2012. Will the court consider this his 3rd DUI and charge as aggravated felony, or has enough time passed between the 2 previous convictions?
Your boyfriend is at risk He needs a lawyer.
Boyfriend got DUI in IL has paid some fine but still owes and needs to take classes. He was given a year but due to financial
Harship and birth of our daughter he had not been able to comply. Will he go to jail?
It's always better to file for an extension BEFORE the state files to violate his probation. Get yourself a lawyer ASAP...
Is there any purpose to having legal representation for a DUI-1st time offender?
My daughter was pulled over because her headlights werent turned on & was told to take a breathalyzer test so she did. We now find out that she did not have to do that. She said they never told her it was an option. They just told her to breathe into it & she did. She went to jail and I had to pick her up. They wrote on the ticket that it was .181 and her pupils were dialated with open alcohol etc. My daughter says thats a lie-there was no alcohol in her car. The IL DMV sent a letter indicating her license will be suspended next month. Is there any use in fighting this? I am in no way condoning or taking away the seriousness of this offense but we keep receiving all these letters for DUI lawyers. Will she go jail? She does not have a record. Shes in college and works. Pls Advise
Very simply put, your daughter needs an attorney. There are many great DY defense attorneys in the greater metro area....
I had a DUI and a driving on a suspended license charge. I was told a DUI is not eligible for a sealing.
I think the driving on a suspended license charge is eligible. Both charges have the same case number. Is it possible to request to seal just the driving on a suspended license charge?
You are probably mistaken. Each charge should have its own docket or case number although the numbers will be...
I was charged with DUI 5 years ago, got it cleared in court but still shows up in my fingerprints. How can I get that fixed?
I have no other tickets, never have done any other offense, was not given supervision, only had to go to victim panel and some classes and pay fines. I did not have a suspended license either, was able to drive the next day and given my license. I thought after 5 years would be off my record but when I went to get my fingerprints, it showed up and I'm trying to get a job in early childhood center.
It sounds like you received a sentence of court supervision. Under Illinois law, this was not a criminal conviction,...
DUI IN TAXES, Illinois resident
I am an IL resident. I had a DUI in IL almost 3 years ago which I was not convicted with. I got supervision. Almost a year ago I was pulled over in TX for driving under the influence. My BAC level was 0.15. The charges are still pending. I was wondering if I can bring that case to IL the state of my residence and have an IL lawyer to represent me instead of going back and forth to TX. Also, I had to install an ignition interlock device in Denton County, TX as a requirement of bond. Will my DUI from IL that got reduced to supervision be treated as a first DUI in TX and then a DUI from Taxes considered as a 2nd DUI. I have an attorney in TX but don't rely on him. Is there any way to bring that case to the state of IL? Or is it better to be held in TX?
In a word, no. Two different sovereigns and two different laws. Get chummy with your Texas lawyer.
