In Texas, is it possible to get a DWI while riding a bicycle?
A friend of mine is convinced that, in Texas, you cannot be charged with DWI if you are riding a bicycle. Is this actually true? I've heard stories about people arrested for DUI/DWI on a bicycle, but I can't remember if any of them actually happened in Texas.
It is possible. More likely a PI charge would result.

Can they use a out of state DUI against me if the conviction if the Conviction gets set aside?
Got charged with 2nd DUI in Texas. Have another one from another state though/ Was booked in for Class A Misdemeanor 2nd DUI, Have another DUI from another state though, will they find out about that out of state conviction and refile as felony. Also this state has a set aside law, like expungement, I just have to pay off some fines and file for it. Would this help shield me from a 3rd if I can get that done? Thanks
If you can get it set aside I would do that as soon as possible, but they may not allow you to do this since you have a...
Whats the difference in being charged w/a DWI & being charged w/a DUI in Harris County and Why a GrandJury in misdameaner case?
Allegedly an officer found what he believed to be Ecstasy (was really a Cloanapin) in Husbands front pocket after finding him asleep at the wheel. Husband was taken to hospital for highly elevated blood pressure & pulse due to heart issues and was discharged from hospital. Hospital even called a cab for him after discharge. A few days later, the law kicks in the door for a felony warrant for his arrest, charging him with PS PG 1 and PS PG 2 Almost a month later, they issue another warrant, charging him with a misdemeanor DWI -stating that the officer completed a Grand Jury Supena for his blood work bc he was unable to give consent that particular evening. Medical records return that there was only amphetamine in his system.
First off, I'm sorry this is going on. It's always difficult when a family member in in legal trouble, especially a...

What is a CFI? Can 2 months of DA not following through be grounds of dismissal with test copies?
A friend of mine hired an attorney for a DWI case, which they agreed on a payment plan totaling $3000 for representation. My friend paid $1300, but their parole officer issued a blue warrant, which put him on hold in jail until the outcome of the DWI case. So when the attorney was notified, he threatened to file a motion for withdrawal and a "theft of services" against my friend, who could not finish paying from behind bars. The case is in court today, which shows that attorney filed a CFI. Also, my friend got back from the forensic lab certified copies of his lab results showing no alcohol or drugs in his system, but the DA reset the case from March saying he wanted a retest. As of a few days ago, the Harris County Forensic Lab has confirmed that the DA has NOT put an order in for retesting.
CFI = "court of first instance"
