Im in the processing of getting a visa for my husband, he is being sent back to mexico on friday and was just put in jail for DUI and open container. Does he still have a chance to get a visa or are his chances ruined?
A single dui offense generally does not make a person inadmissible. Being sent to Mexico however brings up other issues....
I got a DUI 9/13 in KS. I filed within 10 days for a hearing with DMV. I won hearing with DMV based on evidence that the cop didn't fill out form properly, but changed his copy before mailing to DMV to be correct for them. Therefore they dismissed any admin actions against my license. I then plead guilty to my DUI 5/14. On 9/15/14 i received a letter dated 9/11/14 that my license was suspended effective 9/11/2014-10/13/2014 and then 6 months interlock device. (nothing like giving me a notice, I'm glad I wasn't pulled over from 9/11-9/15). They already "technically" took my license once, they just could not actually take it because I won my DMV case. Is it right for them to take it anyways? what was the point in filing a hearing if they took anyways. they can't take twice??

I fulfilled all but one obligation assigned by the judge upon my DUI sentencing. I have 20 treatment "classes" to attend and have only been to 4 so far. I'm still going and progressing very well. Fact is i wouldnt have been able to complete 20 classes in 3 months anyhow since they are once a week so i have to reappear next Friday. Unfortunately, being truthful during the evaluation has not worked in my favor since the judge seems to be turning this into more of a marijuana issue than a DUI issue.
