Probation breathalyzer violation follow-up question
Can NyQuil result in a BAC level of 0.11 on breathalyzer? And if not that, how about a BAC of .084? Or would proprietary ingredients in NyQuil be able to differentiate that from vodka anyway? I am currently on probation for DUI, with breathalyzer tests Frequently during the day. Does a breathalyzer have any way whatsoever to distinguish NyQuil from vodka? I realize they are both alcohols, but could it differentiate by using proprietary ingredients of the brand in NyQuil which would not be present in vodka for example? Would a BAC as high as 0.11 be inconsistent with NyQuil and rule it out if assumption was made that at that level, toxicity from nyquil's other ingredients would be present (acetaminophen for example)? Could the two be differentiated by increased liver function tests, which NyQuil causes, And if so would that be routinely requested by probation officer as follow-up? In short, is there ANY way that a breathalyzer could reliably distinguish NyQuil from vodka given a BAC of 0.11 or .08? Iis that in ANY way legally defensible?

I am currently on probation for DUI, with breathalyzer tests every four hours during the day. Does a breathalyzer have any way whatsoever to distinguish NyQuil from vodka? I was pulled over taken to the hospital for a DUI for substance methamphetamine.
I was taken to the hospital however told me he wasn't going to press every charge she could if we had taken to the hospital cuz I need to come to his family. In his paperwork it states that I refuse to blow or take a blood test which is not true they did this at the hospital I did not refuse to take a blood test or to go to the bathroom for him or the nurses. Now it states that I have to have an interlock system and my license has been suspended a year and still is is there a way to find paperwork from the hospital showing that I did not refuse any of this. We also get my money stating that the FBI need you look at it it was Christmas money and I have proof of that I got it out the day before Christmas I had to be in in time for you with this money questions on Lost $1,100 because it was holding on to it and I did not have anything for Christmas leftover. Can you tell me I would not be able to get it out and when I went in to get it at the Highway Patrol office in Salt Lake City got to see my ID got my money back with no problem at all
Your question is disjointed so I can't really understand the issue clearly. Please contact an attorney in your area...

I live in Utah and in section 8 housing. I use marijuana away from my home, to help control my epilepsy. I have no convictions
I'm worried I'll lose my voucher, if I have a positive drug test for marijuana. I have to have urin tests to receive pain medication from my doctor. I worry that the results will be made available to the section 8 program and I'll lose my voucher. I have no arrests or convictions of any kind.
Hope it all works out best to ask the section 8 people upfront or your lawyer,
Can a judge punish you for drinking even though he never said you couldn't drink?
So my case is still pending for DUI and my attorney had a couple of conflicts so we just rescheduled my pretrial conference. When I showed up 3 weeks ago my attorneys assistant forgot to tell me that it was rescheduled. So I talked with the judge for a minute and he asked me if I had still been drinking and if I would pass a test had he chosen to give me one. I told him I didn't know and that yes I still drink but I haven't been driving. He proceeded to lecture me for about 5 minutes and said that is something he takes into consideration for sentencing. He said I should completely give it up get treatment etc etc. Can a judge try and run your life like this when you haven't even convicted yet? In fact it is kind of ridiculous they can tell you not to drink on probation when you aren't even driving. He didn't tell me to not drink but he did tell me that I shouldn't. I will still drink but not drink a couple days before the next court so I can pass a test if he actually gives me one. Can he really try and run my life like this when I haven't been convicted?
Don't be so paranoid. He was merely suggesting things that he feels are in your best interest. Frankly, anyone who...
