Will the DWI arrest be included in the non-disclosure order after completing a deferred sentence for obstruction of highway?
I am likely to receive an offer to reduce a DWI charge to obstruction of highway with deferred adjudication, and will need to make the decision I assume all face between accepting the offer and taking my case to trial. However, I wanted to confirm that upon successful completion of the probation term and the passage of the two-year waiting period, I can file for an order of non-disclosure that will seal both the DWI arrest and the sentence on the obstruction charge. Since the deferred was not granted on the DWI charge (as is not allowed), but instead the second obstruction charge, does that make the record of the DWI arrest itself ineligible for inclusion in the order of non-disclosure? Thank you.
This is squarely in the realm of legal advice, and we cannot give you legal advice without fully understanding the...
How do I get proof that I was not charged for a DUI?
on an armed forces base and detained while underage drinking(at the time) and dui. I however, did not go to trial or courts martial. Is there a way to get any sort of proof that I was just detained and not charged? I should add, I was a part of the military and stationed on said base at the time of the incident.
I can't think of one. If an employer would try to look, nothing should show up. Your local police agencies may find a...

Can i fight an extension on my breathalyzer?
I was arrested for a 1st offense dwi. Ive paid all my fines, taken my classes, done community service, and completed AA meetings. Ive fulfilled all requirements of my probation, but have been extended for 6 months to keep my in-house breathalyzer. I was sentenced to have it for 1 year, but have had it for well over that, and cant seem to get rid of it. I havent been locked out or failed a test in over a year. Is there some way i can fight my extension so that i can be off probation and move on with my life?
Of course! Get a lawyer, tell him what you just told us and I do not see why he cant argue it in front of a judge....
What will happen to me since I violated my breathalyzer one time?
I got a DWI in February in san Antonio tx. I got a breathalyzer installed in my car. I was doing so well with it but just a few days ago, I tried to turn on my car after a night of drinking and I violated it. It was honestly a mis-judgment. I felt fine and my friends were convincing me I was okay to drive. I'm really scared. This will never happen again. What will be my consequences if any for violating it one time?
It depends. Are you on probation already for the DWI or is it still pending? Most likely in Bexar County on one...
I have a restricted drivers license from the State of Michigan. It has been restricted since 2003. It is now 2015
I am now moved to Texas and wanting Texas drivers license. We are talking 12 years. Now I have been informed that in order to get a Texas License will need to go through with Reinstatement of Michigan License and an Court Appeal to get a clearance letter from Michigan to get Texas license.
So what then is your question, asker?
On July 17,2014 a judge ordered my Texas drivers license to be suspended for one year as part of a plea deal for a DWI charge.
On July 17,2014 a judge ordered my Texas drivers license to be suspended for one year as part of a plea deal for a DWI charge. To this day 10 1/2 months later, DPS STILL has not suspended my TX DL. After July 17th,2015, can DPS still suspend my license? I have already completed all other conditions of my probation except for this. I am really hoping dps won't suspend my TXDL with like 11, 9 or 3 months left on my probation (July 17, 2016).
Yes, they can. And, they have been known to do that. (You must not have been a first offender, or must have been...
