I have been charged with my second dui. Since my first dui was 9 years 9 months 10 days ago can it be considered a 1st?
I was convicted in Jan 8 2008 for a dui. I have recently got a dui on sept 18 2017. Since this dui is less than 3 months away from the 10 year drop rule is there anyway I could be considered a 1st time offender when judge makes the sentence? Would being in the Marines help my case anyway or showing I've been attending AA since the incident?

I am still waiting for my ARD date for a DUI incident that happened in Erie, PA. This is my 1st offense and no other traffic violations. No restitution. Recently my job required to move from PA to NJ. My attorney had said earlier the PA Commonwealth will send a request for a license suspension for up to 60 days, because my BAC was 0.21. Also my license information will be updated in the PA court records with new address and drivers information. Do you get drug test if you was charged with possession od weed?
I was stopped for my decals on my car and the officer smelled marijuana and ended up searching the car and found weed and a grinder, but I wasn't breathalyzed so my question is during court would I be asked to take a drug test if I was not asked to do one on the day of the incident?

Can I get my license back after being 'non-compliant' once I am paid and scheduled for a class?
I got a DWI a while ago and the suspension from that has been over for over a year. The IDRC was supposed to reschedule me because I could not make it and they agreed to do this but never did and put me in 'non-compliant' status. I spoke with them and sent them a money order today to schedule the class. I am getting two different stories from the MVC and the IDRC. MVC says I can get my license back once a class is scheduled since I paid now and that would serve as me being compliant whereas the IDRC says it won't say compliant till after I take the class. I'd like to get my license ASAP. Any information on which would be the correct answer?

Regarding IOP after DUI case is finished?
Basically, I had left court with a DUI charge. I needed to go to 2 day course, it was 6/8 hours each., After completing that I was told I was required to do a screening and if I had not done well, I would have been placed in an IOP program. So let me start off, I was charged in NJ and currently live there. I had went to the first class, but missed the other one because I walked in literally 5 minutes late, even though I reached there 30 minutes prior. After completing that, I was asked during the class to take the screening. They said due to the fact I crashed my crass during the incident, I was required to take IOP. When I went for a further analysis, because of my past, they told me I was required to attend 2 days a week for 14 weeks. I completed like 5 sessions until they dropped me. I was missing group sessions because of court/work. I now got a full time job working and making a change in my life. The whole point of the treatment was to better my self, and I am, which makes me think they all just doing this for the money at the end of the day. Anyway I was wondering if there is anything I can drive, avoid the treatment, swap for probation, or anything else

Obtaining license in another state after DUI in NJ.
I have obtained a DUI in New Jersey and wanted to know if this would affect me from obtaining a license if I were to move to another state in the future? I know I would have to complete all the conditions and I am obtaining my license soon. Also if I were to move to another state where a DUI is considered a criminal offense would the offense here be transferred there as criminal? Only reason I am asking is because a DUI in NJ is a traffic violation and it would be difficult for me if it were to be criminal in another state though I've met all conditions and fines.
