I got a DWI in VA 2 years ago, I had a Oklahoma license when i got convicted. They suspended my OK license for a year. After checking my Oklahoma driving record (2years later) it says i'm clean not only that but when i checked my VA record it didn't show as well. I went to get insurance (FR-44) and told them about the DWI and they check my driving record a few times and told me that they could not find it. What exactly is going on it seems like I fell in some grey area in this situation.

I was charged with a 1st DUI and in VA, you are automatically charged with wreckless driving as well. I was involved in a one car vehicle accident where I rolled my vehicle and had to be taken to the hospital. My lawyer was able to show there was a break in the chain of custody. The hospital's blood test results, BAC 0.26, higher than blood test from lab my lawyer hired, BAC 0.19. I caught a break and my lawyer got the DA to charge wreckless driving only, with 5 days jail and VASAPattendance due to high BAC. I have not gotten into any trouble since -- not even a parking ticket. Is it possible to have the wreckless charge expunged? This happened in August 2008 and court date with final outcome in April 2009.
No, you cannot get an expungement because you were found guilty of the reckless driving charge.

The person had a dui in NV back in 08 & 09. One here in VA recently, and I'm curious if the Commonwealth is going to use the prior record to enhance the charges here (as of right now, it's 1st offense). If yes, could it get to a felony?

We have one daughter and I currently have primary physical custody and we both have joint legal custody. Would I have a problem getting sole custody of her? He was stopped for doing 25mph in a 35mph(Not kidding) and was arrested because the court order was not in the DMV system. They revoked his court order and has to go to court to defend himself on this charge. Does he have a chance of getting out of this with jail time.
