2nd DWI after 13 years, parts of penalty confusing?
I got a 2nd DUI after 13 years so it was supposed to be treated like a 1st time DWI. I received some penalties which did not make sense to me. The Judge did not order Interlock, ( a good thing) I am guessing because It was not alcohol ( prescription drug, I bumped a car in front of me, Officer said my eyes were glassy) but I was given a 7 month suspension, not 3 months which I thought was the case for 1st time offenders under a certain limit? How do they determine when it is a drug unlike alcohol that you are over a certain limit regarding the interlock anyway? Why would a judge make anyone have Interlock when it is not alcohol, it does NOT show up on the machine you blow into? Some Laws pertaining to DWI/DUI don't make a lot of sense, seems to be more about punishments/ & money than possibly giving help to those who may be addicted to alcohol or drugs. How does excessive fines and paying for programs and all those funds and the worst the 3k Surcharge over 3 years help? I know you must pay a price but depending on the situation, not a one size fits all.

Why doesn't NJ have a Conditional Driver License for work or school in DWI cases like most other States? It is not right.
I would like to know the reason N.J. does not have a Conditional License when so may other States do? My son-in-law lost his job due to a one time mistake in bad judgement. He ( our family) wrote to legislators who agree with us but 2 yrs later and still nothing about changing that, he also needed rides to the I.R.D.C. and AA meetings & many other places and with losing driving job he didn't have the money to pay all those fines and penalties!

NJ Driver. First DWI in NJ, Second in NY. NJ IDRC punishments?
My first DWI was in 2008 in New Jersey. I got a second out-of-state in NY in 2010. My BAC on the 2nd offense was 0.16. Just last year (2014) the state of NJ has reached out to me to undergo IDRC. I was sentenced to 3 years probation by a NY judge, being carried out in NJ. Will this treated as a second offense in NJ? Since I never faced a NJ judge for the DWI offense, how do I report community service, or do I even have to at all? Will somebody tell me I must spend 2-90 days imprisonment? Lastly, if I am ordered to undergo 16 weeks additional treatment, can I complete this if I move out of state?

Can an experienced "DWI" attorney represent me on short notice TOMORROW for a 3rd offense DWI matter?
It is my third offense, and I am trying to avoid the mandatory penalty of 10 year license suspension & *ESPECIALLY* the mandatory jail time. I do have a drug problem and have been attempting to get checked-in to an inpatient rehabilitation center however it has NOT been that easy to get into one on such short notice. I was in court last Thursday & met with the Public Defender for the first time however he did not offer me any type of deal nor try to help me in any way, therefore I informed the judge that I was not happy with the services given to me by the public defender and I suggested to hire my own attorney (the judge was furious with me but thankfully gave me a 1 week extension to return to court with my own attorney the following week). Can I get my dwi case dismissed?
Back in April I got a dwi in which i crashed a vehicle which wasn't mine and damaged some property @ blew a reading of .20. I was given a court date by the arresting officer for the following week. I hired an attorney, who put in for a postponement, entered a not guilty plea & requested the discovery. Its been over 5 months later, my attorney still hasn't received the discovery or a court date. He thinks the court may have lost my case. He's just telling me we should keep quiet & see how it goes, but if there's an chance of it getting dismissed due to the lack of providing the discovery, I'd like to get this over with already. I'm just looking for a 2nd opinion, ultimately I'm going to follow my attorneys advice. Thanks

DUI arrest with pending conviction. Question on I-485.
I am on H1B visa with an approved I-140 on EB-2 (India) with PD Aug 2010. I was arrested on March 1st 2014 for a DUI incident with a BAC of 0.13. Found a DUI attorney on AVVO helping me with this case to reduce the charge to a lesser offense. 1) If I am convicted for DUI or a lesser alcohol related offense and placed on probation and while serving my probation if my PD becomes current, can I file my I-485 application by stating my arrest clearly in the I-485 application? OR 2) If I have to wait until the DUI case is closed prior to filing my I-485, then by the time the DUI case is closed, it is possible for the priority date to retrogress and in which case, I will have to wait until the PD becomes current. Is that correct? 3) If 2 is correct then can I skip filing 485 even with current PD
Generally, ordinary DUI is not a bar to adjustment of status.
What punishment is there? In what way can I avoid going to jail? Will I be able to appeal to the judge with this situation?
I was convicted of a DWI in Oct. My 6 mos suspension was up in Apr, but I still have not attempted to restore my license because I had not attended IDRC class yet. I was originally scheduled in Feb but had to reschedule. The rescheduling date was for May. I knew about the $230 fee because I had talked to the women on the phone about it but she told me that was the only fee. I was looking up what to expect from the class, many things were saying that as a part of the IDRC fee, you have to pay the $100 to the DMV as well. Confused, I tried calling the number, but no one answered. I assumed that I could not attend the class because I still had not paid the $100 yet because there was a letter from the MVC saying I just owed $200. Now I have a letter of noncompliance and don't know what to do.
