How can I win a hearing to overturn an open container violation?
I was walking at around 8:45pm with a group of people while carrying a half drank beer in my left hand. The group and I crossed a four way intersection, and were then standing on the other side of the street. I switched the beer to my right hand so it was out of the point of view for any cops. I then saw a cop approaching me from my left side and he told me to come with him. He asked me to take a seat then took my half drank beer. Came back asked if I was 21 and were I was from and I said I am 21 and I'm from Somerset pa . I was visiting friends at the time from iup. He cited me for an open container , didn't breathalyze or make me take a sobriety test and let me go.... my dad being a state trooper I called him for advice and he said my best bet was to go to a hearing and challenge it because he might not show up , and the police officer let me go with my can of beer empty and told me to throw it away in a garbage can. He said that since he has no evidence, no tests from the beer or from me that he has no evidence that what was in that container actually was beer.. do you have any advice on this matter?
