3 dui's, 1st age 17, 2nd 19 and 24 - Felony in Michigan. Any chance of dropping, lowering or losing felony charge?
Since this time he has received B.A. in History. Hasn't had a drink, fulfilled his probation in 2 1/2 yrs. of 5 yr. sentence. Is working but probably below what he could be doing? Hired a Attorney for the last 2 dui's, never did we receive counsel for any appeal or options that may have been available, like we found out later that you have 42 days to appeal the charge. Did we have option for Appeals? Is this something that should have been brought to our attention? We were so overwhelmed we didn't ask many questions when this was going on? Looking back, we feel like our attorney never gave us any options, he just had us run with the play. Is there anything that can be done?
NO. OWI is one of the felonies that cannot be expunged since it remains on your driving record.
Facing third owi in kent county Michigan. Refused breath test at site of accident but did one at station no blood test.
have had three owi offenses in the state of grand rapids Michigan one in 1995 second in 2004 and my third 2015. what are my chances with a good attorney?
Chances at what? You are facing a revocation of your license and a minimum of 30 days in jail. On top of that, OWI...
Can a deferred judgement for a DUI prevent me from obtaining a driving position?
I received a deferred judgement in 2013 for a DUI. I have completed all of the terms that were requested and it does show up as being deferred. I am trying to apply for a position within my company and they're telling me that I cannot have a DUI on my record that is within 3 years to be eligible. The 3 years will be in August of 2016. Since this was deferred and all the terms have been completed can they bar me from this position?
I am not sure if you can obtain the employment you seek; however, I also am confused with your question. When you use...

Is Michigan the only state that trys to use past convictions for DUI/OWI for new charges?
My husband was charged with 3rd owi and when we went to court his lawyer said they are trying to use a 9 year old conviction to give him more time for his crime. He did have some charges excutated from his record from MS Supreme Courts back in the 90's and they are trying to use that also to say his a hibutal offender so in MIchigan if you had charges from years ago and they were taken care of Michigan can use them again when your charged with a felony even if the charges are more than 10 years old?
For habitual purposes, the government can use any felony convictions no matter how old they are. There is no limitation.
Can the police mail prescription drugs through the mail?
I was recently arrested for OWI drugs. It was all prescription medication. The police mailed some of my prescription drugs back to me though the mail. I thought that mailing any kind of drugs was illegal. Was is improper y the police?
They're the police. They probably can. More importantly, complaining about it or pursuing it any further will not...
Probation Violation?
In November I was arrested and charged with a OWI in Ottawa County. Recently had sentencing with Judge Kenneth Post and graciously gave me a year probation, minimal fines and 3 days JAWS. Today was supposed to be my first day of JAWS but I was 4 minutes late due to missing the camp and having to turn around. The supervisor gave me a breathalyzer and then told me I would have to leave. He said 8 was the cut off time. I understand that and this was truly a simple thing. But now I'm incredibly nervous because in my morning oats I always put 2-3 drops of vanilla extract in my oats. I'm not drinking, I'm following all the other things on my probation and honestly I'm ready to move on from this and live an alcohol free life. I'm newly pregnant with my 3rd child and just nervous. Opinions?
You have provided a great deal of detail about something, exactly what I'm not sure but you have not asked a question.
