Recently went to court for DUI, accepted the plea bargain.Upon registering for a work program, my time doubled. Can I appeal?
*First offence, over 21, non injury, BAC .17* I was given the offer of either 13 days minus time served(2 days) for a total of 11 days in jail, 11 days work service(CalTrans), 147 hours community service or pay $1,773 in fines. I chose the 11 days of work service. The judge agreed and I plead no contest on the agreement I would be able to do my time out of the county I was arrested in, Los Angles, because I live in Santa Barbara and could not commute. When I went to the office to register for my community service, I was notified by the clerk that CalTrans does not accept out of county transfers, and the only option was to do 147 hours at a local non-profit. 88 hours turned into 147 hours. Had I known this I would have done the jail time. Is it possible to appeal?
I would imagine that you can get your case back on calendar in the court where you were convicted and talk to the judge....
Could i legally physically assault an unruly drunk guest in my home?
Lets say im at home relaxing (sober) in my apartment i share with two others. One of my roomates shows up with his buddy (we arent buddies) and they are drunk and are still drinking. The drunk buddy of my roomate picks up a switchblade and walks slowly towards me opening and closing the blade but its pointed downwards to the ground and not at me while saying some insults to me. At this point i feel threatened could I legally punch this guy out? I didnt punch him out but My verbal reaction was enough to make him leave eventually, however, if it happens again i dont think i will be able to restrain myself. Thanks.
No, you cannot legally physically assault an unruly drunken guest at your house based upon your hypothetical set of...
Dui dismissed but license still suspended? and i need an sr22 which limits me from many jobs with bigger companys
i got arrested for a dui hit run when i was not the driver. the driver had crashed my car and would not admit to it when the police showed up to our house. i was drunk at the time and the officer breathalized me and arrested me because the driver would not admit to it. The driver decided to come forward in court and i had letters from many witnesses including his girlfriend. my case was dismissed and the charges were transfered to him. the attorney and da said the dmv should reinstate my license, but never did. i called the dmv and they said that my license is still suspended because i blew alcohol in the breathalizer and i was under 21. But, i was at a household at the time and never convicted of anything. So, is there anyway i can get my license back and not have an sr22.
I would ask the DA to sign a DS 702 and request a do-over of the DMV hearing which you apparently waived or lost. The...
Im 21 and got arrested for drunk in public in a city called IV went to jail overnight what are my consequences?
a guy was skating by and yelled a discriminatory word out to me and some friends, we had a pushing confrontation then left the scene. Witnesses pointed the foot-patrol in my direction and arrested me for being drunk in public. When I was face down on the ground the cop asked me to get up and if I needed help up (with my hands cuffed behind my back) I said no I proceeded to get up without stumbling or falling (like a drunk/wasted person). Spent 10 plus hours in jail.
You were arrested, but were you given a citation or ordered to appear in court? It sounds like maybe they took you...
21 year old passed breathalyzer but got jailed and blood tested. What do I do?
I was pulled over with the officer citing excessive speed and not observing the right of way even though I made a legal right turn that had no stop sign. Officer will say that I failed FST but I believe I passed and I also blew under .08 as my citation cited (a) instead of (b). I had taken xanax earlier in the day but was not impaired from it. I had 3 beers at around 1130 PM, was arrested at 230am, and tested at 330am; I was tired but not drunk. Would the police test for xanax, and is there anyway I could fight this off? I don't have a prescription. My blood will be completely clean of all other drugs and my BAC should be ever lower. I want to save money but get out of as much trouble as possible. What do I do? Public attorney or lawyer, now or wait until blood test result, how much, etc.

Drunk in Public (p)647 misdemeanor. Finished deferment program. Will this effect law school admission/future job applications?
I got a DIP in the college town of IV. I was given the option to do a drug alcohol class and have the misdemeanor removed and a noise violation infraction added to my record. I completed the course and will go to court on Monday to pay the $404 fine. They told me the misdemeanor gets dropped... My questions are.. Will the misdemeanor or infraction show up and possibly effect admission to law school? Do I need to share this on applications to jobs and/or law school? Can I get this expunged when I go to court and pay my fine (do I ask the judge)?
The misdemeanor arrest will always be on your record. Employers may not legally inquire about arrests w/o conviction...
How can I expunge a DUI from my driving and criminal record?
A little over two years ago I was arrested in Santa Barbara, California, for driving under the influence. I registered with a .09, which is .01 over the legal blood alcohol content in California. I had never been arrested before, nor since, nor do I have any history of alcohol abuse or alcohol related problems. Most recently, I was offered a position which paid very well and was in line with the line of work I would like to be in, but the organization opted for rescinding the offer of employment once they decided that my driving and criminal record would be a liability to the organization. Needless to say, I would not want to go through that same experience again. Additionally, I think moving forward, even if I have an advanced degree in the field it would not serve me well if I would not be considered for positions because of this incident. So, I would like to know how I can put this behind me. Any suggestions or thoughts would be very much appreciated. Thank you.
