Can a defendants statement be used against him if he was obviously and knowingly intoxicated upon writing the statement?
The accused is initially being charged with a felony sex crime, and four misdemeanors.He spent a month incarcerated and was R.O.R, scentencing was postponed pending a PSI and R.O.R was granted based upon agreement of reduction of all charges to a Sex abuse 2nd charge. However, according to the public defender the major reasoning for the charges Is the DA has a statement the defendant wrote against himself, but the defendant was intoxicated and upon mental evaluation, was found to be suicidal when the statement was written, is this legal? Also the defendant unknowingly agreed to the plea deal for the sex abuse second, can that guilty plea be retracted? and is there grounds for dismissal?
In order to determine whether the statement is admissible the Court would have to hold a Dunaway-Huntley hearing....

Conditional license from DMV?
I was recently convicted of DWAI in New York. I also attended a hearing at the DMV because I refused to take the breathalyzer when I was arrested. After the hearing, the DMV took my license away for a year based on my refusal. Can I get a conditional license? The woman judge hearing the case was really mean.
You can apply for the conditional license in light of the plea.
NY State DWI/DWAI predicament - live in New Jersey
My sister received a DWI in NY State in June, She works for a large pharmaceutical in New Jersey, and her job is 85% travel. Without her license, her career is in the tubes. Yes, its always easier to say after the fact and realize the error of your ways.The question here is this lawyer suggested that he will have a better chance of pleading down the case to the DWAI, if her employer would provide a letter she would be fired if convicted. (There is no doubt she will be). However I work for a similar size company and I have a friend in HR who told me no ethical company will provide a written statement like that, regardless that she will lose her job. Before she lets the cat out of the bag to her employer, does this increase the chance of pleading down? Considering other counsel.
She should listen to the lawyer who gave the advise. He or she is in the best position to advise your sister.
DWI Refusal hearing
I attended my first hearing at the end of April the officer didn't show so my license was reissued immediately. However, as of today (8/20) I have not received notice of my second hearing. Is this normal? From what I'm being told I should have had a second hearing within a month of my first appearance.

Does this look reasonable? Please note that this traffic infraction differs decidedly from a violation of 1192.2 - Driving While Intoxicated offence in New York, which is a criminal misdemeanor and reflects a blood alcohol level above the legal limit of .08% BAC."
