Is my first DUI in illinois a felony?
my first DUI in illinois. is it a felony ? if so will i go to jail? heres a quick background. No prior DUI's or criminal history. had valid insurance and license at time of arrest. i wasnt driving a school bus. didnt get arrested in school zone didnt casue a death or a injury resulting in permanant disabilty. did not have any children or anyone under 16 in my car. my big fear is my BAC, its was over 3 times thelimit. does this make it aggravated or felony? do i have a higher chance of serving jail time? any chance of court supervision?
If you have no criminal background to enhance the charge and no injuries to enhance the charge then your first DUI...
I have a high BAC in cook county illinois
was arrested for DUI misdemeanor in cook county illinois, court at markham courthouse. this is my first offense and i have no prior arrests or dui's. i also have NO aggravating factors that would make this a felony like driving a school bus, or crashing and hitting a car, injuring a person etc. what i am worried about is that i have avery high BAC like 4 times the limit high. is it still possible for me to get court supervision? or more liely i will get some jail time? feel free to be perfectly frank , i would highly appreciate it.
You are eligible for court supervision, even with the high blow. There will be a requirement of community service as...

I recently got my 1st DUI. Is it possible to get this expunged?
I was dropped off at my car. Since I had been drinking, I made a decision to sleep in my car and not drive. I was parked in a dark private lot (mini plaza). The officer knocked on my window ( I think he thought the car was abandoned). My car did smell of alcohol and I took the breath test and it was .11 (Illinois is .08). I do have a trial coming up and my license has been suspended. Also, can I travel out of state in this situation? I have family outings coming up. Please advise!
You likely cannot travel out of state. Your bond likely restricts your movement outside of Illinois, but you can have...
Can I get my DUI supervision reinstated?
Got a DUI in 1995, did classes and victim impact panel, but did not appear at the end of supervision date and my supervision was revoked and a conviction was entered in 1996. I know it is very old, but there is an outstanding warrant so maybe the case is technically still open. I am wanting to go back in to get the supervision reinstated and then satisfactorily terminated so the "license revocation" will be removed. Can this be done? And if not, what am I supposed to do now? I don't live in Illinois anymore, but just want to clear this up
You need to contact the attorney who handled this matter or another attorney to address this for you. Although you no...
Should I make this deal or can I countersue the department?
I am a 1st time offender. I was arrested for DUI (marijuana) and the illegal possesion of a weapon (stun gun). But, I still had my GA license and they don't need a FOID card and the officer accusing me of DWI is NOT certified by a judge. Now, they insist I take a deal: take a DUI suspension and the misdemeanor will be dropped. I feel that this is wrong. Shouldn't my case be dropped if he lied about being certified? And he also lied on his testimony stating I didn't know if my car was mine, but in the video I simply stated it was mine. My lawyer doesn't think this matters, but I don't understand why I should have to take the deal if the officer wasn't certified to begin with. I had to pay to get my car from being impounded. Shouldn't I get that money back? Not pay more.
