I had a DUI five years ago and got court supervison for it now I had another one now and refuse to blow what will happen to me?
Someone call and say I was driving bad and police found me pass out behind the wheel and didnt blow but did admit to drinking eariler that day
Refusing to blow will not remove or reduce the charges and in fact could affect your license even more seriously. The...
What is the maximum sentence for driving while revoked in IL?
girlfriend called police after an argument and said i stole her vehicle, (she let me use it to go to work and did not report it until she knew i was on my way home and she is not the owner of the vehicle either, it is in her estranged husbands name and he lives in another state) but the police said the reason for pulling me over was because my license plate light was out (it was still 2 hours before night fall). I was arrested for driving while revoked but I was not read my rights. I have gone to court 4 times over this now, it keeps being held over. I now have a jury trial coming up ( I also have my physicians letter stating she does not believe my mental health will allow me to serve jail time but the court is refusing it). what are my options in this matter?
Your options are 1; prove you were fully licensed at the time of the arrest; or 2) prove you weren't driving at the...
If I was pulled over for DUI and the case was dropped do I have to pay the reinstatement fee for my driver's license?
The case was dropped because I was wrongfully pulled over. 5 years later, I went to DMV to renew my license and was told it was suspended and I would need to pay the reinstatement fee. I was never notified of the suspension.
Check with your attorney to see if the summary suspension was rescinded in addition to the DUI being dropped. They are...
City Ordinance Violation for Underage Drinking
I received a city ordinance violation for underage drinking in Champaign, IL. I have 21 days to pay the fine, but I already have the money order and will be mailing they payment tomorrow (19 days early). The documentation that I received is confusing. However, it says that if I pay the fee on time (before the 21 day period is up) that it will be considered a settlement and not a conviction. My question is, is this true? And what do I have to do to get this expunged from my record. Although I know it is not a criminal conviction and most likely won't affect me negatively in the future (please tell me if I am wrong here!), I want to get it removed from my record asap. Is there a waiting period and which expungement should I file? How will/will this affect my driver's license?
Before you pay any fine or make any admissions, you should consult in person with a Champaign County attorney who...
Am I eligible for a BAIID on a 2nd DUI arrest?
I was arrested 6yrs ago for DUI and have not had any tickets or violations since. I was arrested last month for another DUI and recently received the notice from the state saying my license was to be suspended for one year. I know that I will have to go the 30days without driving but can I get a permit or something for the rest of the suspension?
If your confirmation of statutory summary suspension says that your are a first offender then you are eligible for a...
Can I get my DUI supervision reinstated?
Got a DUI in 1995, did classes and victim impact panel, but did not appear at the end of supervision date and my supervision was revoked and a conviction was entered in 1996. I know it is very old, but there is an outstanding warrant so maybe the case is technically still open. I am wanting to go back in to get the supervision reinstated and then satisfactorily terminated so the "license revocation" will be removed. Can this be done? And if not, what am I supposed to do now? I don't live in Illinois anymore, but just want to clear this up
You need to contact the attorney who handled this matter or another attorney to address this for you. Although you no...
Is there a way to get supervision without a lawyer for a DUI?
I have to go to court for a DYING in June and can't afford a lawyer.
If you believe that you cannot afford a lawyer, tell the court about this, and you will be screened for possible...
