First time DUI, do I not qualify for 4019(a)(7) because I was arrested in 2014?
I got my first DUI in December of 2014 but didn't have court until March of 2015. My court papers show that the 4019 or 1/2 time box is NOT checked off. Is this because 4019 (a)(7) applies to the work alternate programs as of January of this year, and I initially was pulled over and arrested with the DUI in 2014?
If convicted and sentenced you should be entitled to full 4019 credits of 50%

A little background on my case, DUI in Santa Clara county in 2012. My second, first was in 2006 (all time/fines/probation served). I was just terminated for the first time from my California Multiple Offender Program (18 month) for not being in 21 day compliance. I was told by the program I would be eligible to re enroll in 30 days for a fee without a problem. My question is what happens now? Am I going to have to go back to court? Am I going to get a warrant issued for my arrest? Can I avoid all of this trouble if I get re enrolled before a potential court date? Please help me.
You will probably have to go back to court for a re referral to the SB-28 program and have a warrant recalled. DO IT...

What are the possible consequences for red lite violation. While on court probation for DUI?
I received a notice that I must appear in court for red lite violation. I was still on court probation for a dui, ( only had two week left) I would be interested in know what the possible consequences would be. i.e. jail? double the fine? more probation?
Most terms of probation for DUI prohibit major traffic violations such as subsequent DUI's, driving without a valid...
Preliminary field sobriety breath test results
How likely is it for a judge to grant a court filed motion in limine to keep a .11 BAC from being brought up at a dui trial. It is known that a BAC results no matter how high they are, are supposed to be inadmissible in court besides just the positive of negative status? And if the limine motion is granted and is brought up by a clever DA at a trial conference to contaminate the jury, will that constitute a mistrial if the defense objects to it immediately? Aren't judges afraid of appeals for denying motions that have good legal grounds?
Judges aren't really afraid of anything--particularly anything that happens in a misdemeanor jury trial.
Will my DUIs affect my citizenship application?
I am planning to file for citizenship. I have never filed before. Came to US legally as permanent resident over 20 years ago. I have 2 DUIs, one in 2010 and other in 2012. Will I have any issues in getting citizenship?
Yes. Any criminal history in the United States will "affect" an Application for Naturalization (Form N-400)....
