Refused breathalyzer saying I didn't have enough time to talk to lawyer. Contestable? Conflict of interest with Public Def.?
Arrested for a 3rd DUI, on probation, released into DUI court. After failing the roadside sobriety test, I refused the roadside breathalyzer saying I wanted to talk to an attorney first. At the police station I was read my rights, asked, "what constitutes a reasonable amount of time" and was told by the officer they would let me know when it was close(never did). Called a lawyer who said they'd call back. Waited about 20 minutes then called another number. Talked to this half asleep attorney for about 15 minutes not realizing it was a phonebook for 150miles away. I asked to call another, was told no my time was up. I refused saying I wouldn't take it until I could consult another attorney. Is contesting worth a shot? Should I worry since my public def. works closely with DUI court team?
You are facing a criminal charge based on these facts, so I would say that yes it is worth contesting (as would be any...
I was initially stopped for my head lights being out. I was traveling in a well lit area, with inside lights that are always on, I could see well enough, so I forgot about the headlights. (bad habit of mine) My BAC tests were .16. I have had a prior DWI conviction at the age of 19. Since then I have had a child, have a good job, and am attending full time RN classes. I dont know if my case is anything more than cut and dry, and if it worth my time to hire an attorney. I would just like to stay out of jail on account of my child.
Before making any decisions you should consult with an experienced DWI attorney. There are many good ones here on AVVO....
Husband arrested for 4th degree DWI four weeks ago. He submitted to blood test. This may or may not be positive for opiates (which may or may not be prescribed Rx). Spent weekend in jail and was released pending further investigation. After several phone calls, learned arresting officer had his DL. Officer returned DL with corner clipped. Husband has no paperwork from arrest, believe jail lost it. Is DL suspended? What are steps to take now, assuming there will be charges and court proceedings in future?
Yes, his license will be suspended based on the result of the blood test. The suspension can be fought; however there...

I was charged with 4th degree DUI in April of 2013. I am on Supervised probation for a year. Can I go on vacation out of the U.S
On my probation conditions it does not order that I follow the general conditions of probation. In the general conditions it states that you have to ask p.o. for permission to leave the state. Since this is not checked as an order can I go on vacation out of country. I am planning to go to Asia
Generally, on a first offense DWI, there is no restriction on leaving theState. However, if you have a probation...

I have a valid MN Driver's License. My WI License was revoked. Do I need to reinstate my WI DL to drive legally in WI?
I live in MN and have a valid MN driver's license. I received an OWI in WI in September 2012. My WI driver's license was suspended and then revoked. My WI driver's license was eligible for reinstatement on May 9th 2013. I still have a valid MN driver's license and continued to have a valid MN license throughout this period of WI revocation. Do I need to pay the $200.00 to WI to reinstate my WI license to drive legally in WI or can I legally drive with my MN license?
A person with a valid Minnesota Drivers License can lawfully drive in compliance with it in Minnesota. If the person...
