my friend has been in jail for a dwi for 2 months and he barley got papers served to him that say he was arrested yesterday. he filed a writ of habeas corpus and has yet to hear anything
A good lawyer would have forced a hearing in two weeks, not two months.
My first and ONLY dwi of 35 years of clean driving record, paid and complied with every demand, full compliance to the letter of law. Over 7 years later, a new law in affect, they pull up an old dui, refuse my license and extorting more money from me. Holding my license hostage till I pay up AGAIN!!! Somebody has got to do something about these people and thier stupid laws! I live in a very small rural town in the middle of no where, not much traffic, trying to comply and abide by the rules. look at HUMAN circumstances! Ignition Interlocks, PLEASE! anyone can blow in them to start a vehicle, call it what it is, A SCAM and EXTORTION, I even tried to comply with that, My vehicle is a motorcycle and I am refused ignition lock. Just how far are they allowed to go with my rights, freedom!
Because driving is a prilege, one which you abused, and not a right, they can get away with a lot.
In the past I got a DWI charge so I had to do the interlock along with other programs and fines which I completed all successfully. I was denied my license after the completion for the reason being I've been to prison and was asked to to the interlock for 6 more mths and more programs and fines. Once again I completed all programs successfully and paid all fines. The second time around though I fail the interlock one time but it was because of drinking, so I've been denied still for my license now on the grounds because I failed the interlock 1 time.

Campus security guards don't have the power to make an arrest...I was very compliant when they told me to get back in my car....20 minutes later a police officer shows up and arrests me...I feel like my rights have been totally violated..P.s. I did fail the breathalyzer, I was over the limit
Many factors go into a conviction, but campus security can certainly testify that you were driving, if they saw you driving.
I have a dui from 1991 and they ( DMV ) says that I have to have interlock for at least six months because the new law requires me to .. so I thought maybe I fall under some kind of grandfathered law since it was 22 years ago, I am really confused. I am required by the court to attend drug court for 6 months but my husband is moving out of the country. Can I petition the court to hold my sentencing for a period of time ?
