When I was in my active addiction in Oct of 2014 I had an accidental overdose behind the wheel of a car. I was stopped already so no damage was done, no one hurt, but I got taken out of the car and to a hospital in MD. The officer couldn't arrest me, due to being out of state, so he handed me two papers and said here's your court date and charges, being dui possession and paraphernalia. . I was already dealing with MD probation. And turned myself in into MD, did 21 days jail from Nov 6 to Nov 26, and then went to a 28 day rehab, but I got a letter in the mail saying I'm no longer able to drive in del, and until I turn myself into the justice of peace court, they will petition MD to suspend my license. I missed my summons for DE and i want to turn myself in. What do I do, what will happen?

My girlfriend got a DUI on New Years morning around 8 in the morning. We are in Delaware, and she has no previous criminal or driving related offenses. She passed the sobriety test, blew .08 on the thing, and they took her in. She was never handcuffed and I asked her if he read her rights and he didn't. She refused the breathalyzer because she was a phlebotomist at the hospital where they would have taken her. The cop then even asked me if I would drive the car back even though I didn't have a license, that he wouldn't care. I'm not from Delaware and have some experience with how things happen in a DUI stop in my home state, and it all seemed rather unorthodox and I'm wondering if she should fight it.
