I am on probation for a DUI and recently got a driving on suspended 1st time. Am I facing immediate jail time?
I am almost finished with my probation. I only need to pay $1000 dollars and I'm finished. I have court July 22nd to follow up with the judge. I also got in a wreck and didn't stop to give information. My fiance was having a panic attack and needed her meds. The guy I hit followed me home. I am going through an eviction process with my fiance and we have a 9 month old son with us. I cannot leave them behind and do the 12 month underling sentence.
I don't know about KS but you would 100% guaranteed be facing 364 days in jail in FL for DWLS and an additional 364 for...
Do I need to retain a DUI lawyer for a first time DUI offense in order to get diversion?
First time DUI offense was in Johnson County, KS. Previously spotless driving record. DUI did not involve children, damage or injury. Ticketed for not coming to complete stop or using a turn signal, blew .102 which, of course, exceeds the state .08 limit. I have not yet retained a DUI lawyer. I would prefer to take diversion. Does the prosecutor ever work directly with a defendant to draw up diversion contracts? What would a lawyer normally charge to draw up a diversion contract in a case like this? I need to know what kind of expense I am looking at... Thanks!
Yes, the Johnson County prosecutor will be happy to help you enter the diversion program without a lawyer. They get...
Refused breathtest in Kansas. Can I get a lower charge during administrative hearing?
I refused breath test in Kansas ignorantly. Now, it says I will have a 1 yr license suspension followed by 2 yr Ignition interlock. During the hearing is there a chance to reduce the charge if not completely drop?
If you are asking whether or not you can reduce the DUI that is pending while you have an Administrative Issue over the...
What should my next steps be in this process (DUI, insurance, auto loan, sr-22)?
I got a DUI in June of 2017. Blew .06, but failed field sobriety test and ultimately admitted to being under the influence of another drug -- basically talked myself into a DUI... although I may have still been charged with DUI regardless due to the fact that I hit a curb and messed up my car pretty bad. Was 18 then, am 19 now. The vehicle I drove was bought by grandfather earlier this year; after the event, he sells it back to the dealership (I don't blame him, I'm an idiot). My car insurance (State Farm) has since dropped me. I am uninsured and car-less. Currently enrolled in diversion program. Required 330days interlock device. Problem is, I can't start that 330days without having my own vehicle. Court fees, etc = can't save money to buy car outright right now, so looking at auto loans from lenders who wont turn away an older car (older car=lower rates). I should also note that my mother has an interlock device on her car, but I can't be on her insurance because she has State Farm. My questions: given that I need a vehicle ASAP, what should next steps be, in what order? And where does the SR-22 come into play in reference to getting an auto loan and auto insurance?
You can get insurance under the assigned risk program. Any insurance agent who sells auto insurance can sell you a...
What is a reasonable settlement in a drunk driver rear ending accident?
-My wife was rear ended and the car was thrown into a construction arrow trailer used to signal lane closures. The car is completely totaled due to the damage on the front, side and rear end. We did take her to the ER to get inspected and checked out. Both of us also took off work for precautionary purposes. The gentleman who rear ended us, did not pass a sobriety test and was taken in handcuffs to the police station. Two witnesses stayed at the scene citing erratic driving and possible speeding. The police were called and a report was filed. I do not know if he was charged with a DUI/DWI but it might say in the report once that is available. As for insurance and settlements, I know I could argue the value of the car, the additions I just had added to it and my roof rack that was installed. I can also vie for lost wages. We are fortunate to have another car we can drive, so a rental is not necessary, however, I am keeping track of mileage, trips, time ect and will seek compensation. Big question is pain and suffering and medical expenses. Is there a max I can ask for, or a guide? Any help is appreciated, we are lucky no fatalities occurred and he should be punished.
Consult a personal injury to give advice. The extent of injury, medical expenses, lost wages and other factors are...
Dui charge in driveway.. Cop says he saw me driving.. Was outside of car . in my driveway no keys in ignition ?

Yes, it is a valid arrest. You have no right to object to when or where he approached you as long as he saw you...
If you posses 2 drivers license from 2 states, got a dui in 1 state, do the both become suspended?
A friend of mine has a DL in Utah and one in Kansas. She got a dui in KS for blowing 3 times over. Her license is suspended a year following a year of interlock. However she is planning a road trip soon and is saying her DL in Utah is still valid. Therefore she is diving legally. Is this correct? I don't see how one would have that loophole. Is this smart as she will be the only adult traveling with 3 children? What if she is pulled over in a different state? She has already received a driving while suspended since getting the DUI. Just trying to keep everyone safe!
It is risky to drive considering her KS license has been suspended/revoked due to a DUI. I would advise against it
