What is the likelihood of the DA not filing a misdemeanor DUI for a year, and the DUI becomes subsequently dropped?
Has this ever happened to a client of yours? Or you?)
It happens but there isn't really any kind if pattern, so there is no "likelihood" to speak of. But it does happen. If...

A lot of details in your case seem to be missing. If he was handed over to ICE by the local police, he must have...
As an MFT Intern facing a potential DUI, should I seek a DUI, criminal, administrative, or licensing lawyer?
I expect to take my state exam in the next year, and I heard the BBS is very strict about any form of conviction regarding alcohol and driving.
All DUI attorneys are criminal attorneys, as a DUI is a criminal offense. However, not all criminal attorneys are DUI...
My Daughter plead out on a DUI w/GBI in an accident 2 1/2 years ago with a motorcyclist who was badly hurt but is better now.
against my advise and will be doing 5 yrs w/ 1 year time served in Monterey County. She may have been at fault but his injuries were much more severe as would have been in another auto. It happened in an intersection where an accident reconstruction had never been done.Sentencing date is next month. The PD did nothing to help and scared her into accepting this "deal" otherwise threatening 8 yrs if she took it to trial and lost, Can anything be done after the fact? Can a plea be appealed? Lots of inaccuacies in both police reports but she did test positive for meth in a urine test. Also, she is now 7 months pregnant. and has been in Monterey county jail for over a year except the 2 months she bailed out and got pregnant. I could not afford private council until now.
She can ask the court to appoint a new attorney to her (from a conflicts panel), in order to examine the merits of a...
What is the best way to get a "Sleep Driving" DUI case dismissed? Hire an attorney? What are the chances?
Someone I know has gotten a DUI for "sleep Driving" She has had a clean record her whole life, very hard working mother who unfortunately got the bad side affect of sleeping medication. It was her first time ever going through any type of "sleep walking" She was pulled over wearing sleeping clothes thinking she needed to go to school. (attends school to become a nurse) As i said before, she's had a clean record and has been attending school for the past 5 years with outstanding grades. Short story, she is not a bad person or a criminal. She's an army wive as well, her ambien is indeed prescribed, to help her sleep. she suffers from insomnia and depression (stresses of school, husband deployed, life load to much) What can be done to dismiss her case, she obviously did not voluntarily drive.
Your friend should hire an attorney. These cases are fact driven and the facts set forth in your scenario are to few...
I am a 1st time offender and blew a .19. How do I get my blood test results? Would the cost of an attorney be worth it for me?
Many people argue that with a BAC which is double over the legal limit, the DA will want to charge me the max fines. I also took the field sobriety tests which I think I performed with a few mistakes. Would an attorney really cut my costs? I also don't have the money up front as I am a recent college grad with loads of debt and a minimum wage job. My last question-I assume I will lose my DMV case, as most without representation do. What can I do/say at the DMV hearing to help my chances for getting a restricted license so that I can drive to work? I should also mention that the arresting officer said that I "blew through two stops" (which I don't believe I did), then later he said I had a brake light out, which is true, however, I found it funny he changed his reason for pulling me over.
You will most certainly lose the DMV hearing without representation. There are lawyers in your area who are...
What is the requirement for a "job". Is there a certain amount you must be paid? Is there a certain job description? How do "prove" I have a job? I have always done work in my husband's local office, but he has never paid me. I would drop the kids off at school, go to his office, work, go home, then maybe go back to work a bit, then pick up the kids from school, and go home. I know that a restricted license allows you to only go "to and from employment", and not take your kids to school, & a job that you do not get paid does not count. So if my husband officially "hires" me and pays me would that be my "job", and could I have it be in my job description that I have to pick up his kids? My husband's office is only 2.5 miles from my house, & kids school is on the way to his office-same road
For valid driving purposes while on a restricted license, I would think your job qualifies. If your program is...
