How do I prove a false positive to save face with my employer and possible justice
I took a hair follicle for my work and failed for methamphetamines but have never used drugs so I demanded another test at a different facility unaware it would be sent to the same lab as before which got the same results. What do I do, I am about to lose my job for something I'm totally against. I've consulted my doctor as well as others only to result for me to be labeled as a druggie now. My medications are said not to be a cause for it but the cold and flu medicine I was taking may have but not likely. I am willing to do anything necessary to prove my innocence and take any or all steps to get justice against the laboratory
Cold and flu medicine is a possible culprit. Sudafed is used to manufacture meth. A false positive can be a difficult...
What can I do about a failed hair follicle when I've never used drugs
I took a hair follicle for my work and failed for methamphetamines but have never used drugs so I demanded another test but got the same results. What do I do, I am about to lose my job for something I'm totally against
Most likely you are an at-will employee so your employer need not have ANY reason to terminate you regardless of the...
Is there a law in Ohio which creates a duty for the owner of a car to prevent an unlicensed or drunk driver from using said car?
My father in law (kind of) was stopped and charged for OVI and speed. The patrolman coerced his long time girlfriend (my mother in law) to write a statement that he did not have permission to drive the car under threat that to give permission was a crime, since he does not hold a license, and was in fact impaired. He threatened to charge her with a crime for not calling the police on him.
I am not licensed in Ohio, but in California, where I am licensed, there is such a law if the drunk person is perhaps a...
Can a blood test be used against me in a Dui case in ohio if they withdrew the blood over 2 hours after the accident?
Accident happened at 1925 hours. in the officers statement it states defendent submitted to the test at 2145 hours. No search warrent present. Under the 4th admendment i should be protected from illegal search an seizure
If a defendant submitted to the test that means he consented to the test.
2nd DUI... chances of getting it lowered.
Was stopped due to marked lanes after coming back from a party after staying the night. Told officer I had been drinking the night before. Preformed a FST and took a portable Breathalyzer. I'm assuming I passed the portable test because the officer wouldn't tell me the results. He said he thinks i'm impaired and took me to the station where I blew a .081.
Sure, they're things there that a good lawyer can work with...but it also depends on the prosecutor (and judge); there...
Can multiple DUIs be sealed/expunged?
Between 1990 and 1999, I pleaded "no contest" to three DUI's (two in Ohio and one in Virginia). Each was a misdemeanor. I complied with all fines and courts' sentencing. These are now affecting life insurance rates and I would like to not have to report them. I was a different person and it was a different time. Are these going to continue to haunt me for the rest of my life?
DUI's can not be expunged under Ohio law. You would need to consult with a Virginia attorney to determine if your...
Can I have a retrial after taking plea bargain considered guilty for omvi for incompetant attorney or for misreprentation ?
Her attorney sent someone else to court when she asked him what she should do he said take plea bargain or keep building up more court cost to pay so she took plea bargain guilty. then in court judge asked prosecutor about the test results she said come back insufficient test and only SUSPECTED marijuana crumbs on floor and was a odor no positive proof and attorney never said anything about results came back. She should of only got it for failure to yield.
You can always ask for a new trial or to withdraw your plea. The Judge may or may not allow you to do so. Hire a good...
