When would the police conduct post accident drug test and how does it work?
just curious about the post accident drug testing since most of the article online only mention about someone under an employer contract. Let say if someone have ADHD med and was worry that if a small minor accident happen, would the police consider drug testing? does the drug test will apply to both the victim and the one at fault or will only apply to the at fault one? what if the person is an individual and not under any employer contract, how does that work? and would it even matter if that person took the ADHD med a day ago and it shouldnt have the effect anymore but still showed on that person system such as Urine and Blood? what would be the circumstances? Will I win if I take my prescription DUI charge to trial if my levels were low?
I was involved in an accident. They took my blood and had Xanax and morphine in my system in the state of California. I have a prescription for both and I hadn't taken any of my prescription drugs the day of the accident. It had actually been almost 24 hours since I had taken the drugs. The lab test came back and my levels were Xanax 111+4ng/ml and morphine 89.5+4.7ng/ml. I'm not sure what the legal limits are for these drugs to be in my system. I was not impaired at all at the time of the accident. Someone had just cut me off and I lost control of the vehicle.

The facts of my case are as follows. I was sleeping in my car, legally parked with the ignition on. I was awakened by the Fountain Valley Police. I had no recollection of driving to Orange County, and told the officer I didn't drive. I was given the follow the pen with your eye test and the field sobriety test. I didn't blow in the field. I blew at the station a .08. I have GERD which may have affected the outcome of the breatlyzer. My question is is the Mercer v. DMV defense of the officer having to witness the "volition of movement" an affective defense? Or is circumstantial evidence enough to establish that I was driving?

I Broke up with my fiance recently. We were together for five years and had been broken up for a month at this point, she agrees to hang out with me on my birthday and we decide to go to the bar. Can my California license be suspended twice for the same charge?
Back in April 2011 I was pulled over and arrested for a DUI. My California driver's license was suspended for a year starting June 12th 2011 to June 11th 2012 (direct from DMV, not from court) and my court case was a few days later. My lawyer advised me to push the court date back so he could look into the case more. When I went to court again on August 25th part of my punishment was a one year license suspension. I got a letter from the DMV saying my license was suspended from the period August 25 2011-August 24 2012 (Opposed to the previous license suspension from June 12 2011-June 11 2012.) My question is, is it legal for the DMV to suspend my license twice (adding an additional two months to the suspension) for the same charge? Can it be fought? Or is it unlikely to be reversed?
