How likely will I go to jail for driving on a suspended license when I'm currently on probation for my 2nd DUI?
I just got convicted of my 2nd DUI on July 7. Because I live in Fort Myers, I'm currently on mail in probation. I made the wrong decision to drive off when my boyfriend and I got into an argument. A semi truck was trying to pass me up and his trailer ended swaying a he side swiped me but he just kept going. I was so shooken up that I puled over and 2 minutes later a sheriff came up behind me. He called FHP to the scene and FHP gave me a citation for driving on suspended license. At first my lawyer told met to wait to report to my PO until I had to check in which I is every month before the 2nd online. Now my lawyer tells me that it would look better if I report it right away and I'm not sure what to do. I have some appointments with lawyers tomorrow and I believe I should retain one before I tell my PO in case she decides to arrest me right away for violating. What do you think I should do?
You should have a lawyer before you speak to your PO. That way if the PO takes you into custody for a violation your...
I just finshed my diversion and met all the conditions, can they still drug test me after my term. date?
Met all the conditions for my diversion program case should be drop but was wondering if they can still call me in for a drug test after my term. date.
I'm not certain how it works in Ft. Myers, and I wasn't aware that they had a DUI Diversion program in Lee County....
I was charged with 1st offence dui in the state of Florida in 2012 and it was nolle prosequi. Do I still need to take DUI class?
I was falsely charged with the DUI and went to trial. It was nolle prosequi and I was dismissed. They suspended my license and the DMV is telling me that I must take a DUI class even though the charges were dropped. Is this true? It doesn't sound correct to me.
You have no right to drive in FL (or anywhere); rather, driving is a privilege. DUI's are bifurcated in FL, meaning...
If my DHSMV refusal affidavit shows I was arrested over an hour after it says I was read implied consent is this a valid issue?
I was recently arrested for DUI and refused to submit to a breath test. I have requested a formal review with DHSMV and received the paperwork submitted by the arresting officer. On the DHSMV refusal form the arresting officer attests to the fact that I was placed under arrest over an hour after I refused the test and was read implied consent. Being that this is a sworn affidavit is this a legitimate argument to be raised at the hearing? Also, there is no other clear indication in any of the other paperwork that I was placed under arrest prior to being read implied consent. I am just wondering if this is my best approach at the hearing?
In order for a to truly be an issue that would get the suspension invalidated, the entire set of documents must be...
How do I resolve this inter-state confusion?
I moved from Florida to Ohio in December 2015. While visiting relatives in New York, I was arrested and convicted for a first DWAI. I am a college student (No priors, no run-ins with police, and otherwise a clean record), so I could not afford a proper attorney. Unfortunately, because I was still holding a Florida Driver's license, there is no DWAI equivalent and it went straight to DUI (which ultimately ends my teaching career before it even begins). Since being in Ohio, I have not driven other than the grace period they give me to driver here and have been riding out my revocation. Am I to understand that I cannot get my license back unless I go back to Florida personally? Am I allowed to take a Driver's Program course in Ohio and have it satisfy both New York and Florida? When employers and future landlords run a background check, will this conviction show up as two separate offenses (as I was getting quotes from other insurance companies, it shows a suspension AND a revocation on two different dates? Should that happen?)?
Were you only convicted in New York? And was the conviction for DWAI? If so, you were convicted of a traffic infraction...
After the DUI?
1 year probation... Off early at 6 months. DUI... 1st offense, no priors. 1 year of the ignition interlock with 5 to go. Has anyone ever heard petitioning a judge to allow use of a motorcycle?
the judge does not have the authority to change the requirement. the department of highway safety and motor vehicles,...
Possible DUI - blow or not?
What are the pros/cons to refusing a breathalyzer when it comes to court for DUI?
They cannot prove how much alcohol you had in your blood if you do not blow. But if you do not blow the prosecutor will...
