Will a DUI hold up if I blew a .000?
I blew a .000 after being hospitalized when I hit a wall in Colorado. I was sent to jail where they woke my up every hour because I had a concussion. I had my boyfriends pill bottle with his and my pills in it (I will come back negative for his pills). I was charged with 4 misdemeanors. 1. DUI 2. No proof of insurance (I have insurance was just on vacation in Colorado from Washington and forgot my Proof of Insurance card. 3. Wreckless driving 4. Possession of controlled substance (his pills) Since I had a concussion and blew a .000 will the field sobriety test hold up? He did the "follow my pen with your eyes" and asked me to count backward from 75-68 and I went to 65 and then remembered he said 68. I had a CONCUSSION! I don't remember a lot of what he was asking me. I was hit in the face with two airbags (I was reaching down). I took one Xanex at 11 pm and the crash was at 4 am. I also consented to a blood draw which I am sure will come back negative. Can I get a DUI for the one xanex? Can I get the DUI throw out when the blood test comes back negative? Can I get the misdemeanor thrown out for his pills when my blood doesn't show I took them?

Can a specialty court punish a person without evidence or report?
I am in dui court Larimer County co. Unfortunately I do not have a driver license but had to drive to a counseling session that I have been sentenced to, I was not ticketed or in anyway contacted by any police but counselor says she saw me drive and reported it to the court, so with no official offense or evidence I am facing a sanction that most likely will include jail time, is this legal? Un ethical?
First, it is not illegal or unethical for a DUI court to move forward with a revocation or sanction based upon a...
Do I need to get a lawyer, or will it be cheaper to take the DUI?
I recently got a DUI, I am under 21 years old and had a beer and a sip of a mixed drink at a club. Two hours later I drove a friend home who had too much to drink, and got pulled over for failure to dim brights. I didn't refuse anything and cooperated with it all and got taken to the station for a breathalyzer, I blew a .116 which was a lot higher than I thought. I had taken NyQuil that night from a cold and didn't know it had that effect. But I didn't know it had an effect till the next day so I couldn't tell the officer about it.
Alcohol related driving charges are serious in nature and can have a lasting impact on your life. For that reason, I...
How do I reinstate license after an under 21 DWAI conviction if I don't own a car to install interlock on?
I was convicted of an under 21 DWAI in Colorado in January of 2015(Marijuana related). It has been a little over a year since my conviction and I am eligible to reinstate my license in a couple of months. I did refuse a chemical blood test so I am required to have an ignition interlock installed in my vehicle for two years. I do not own a car at this time, it was sold shortly after my conviction. My problem is that I will most likely need to get a loan to purchase a new vehicle, and the car dealer probably wont give me any kind of loan without a license because an unlicensed driver cannot be insured. This puts me in quite a predicament because as far as I know I will need to have the interlock installed in my vehicle in order to get a license. I am not 100% sure on how reinstatement works and am curious if there is any way the DMV will issue me a drivers license without an interlock installed (because I don't own a vehicle), but with some agreement to have it installed once a vehicle has been purchased. Thank you for any insight that anyone has to offer.
You can complete an Affidavit of Non-Ownership to get your license and then purchase the vehicle. Contact my office...

I had a DUI arrest in Colorado that resulted in dismissal at court after a successful motion to suppress. Can I seal this arrest record to prevent it from showing on background checks like the FBI fingerprint background check?

Can plea change after a DUI pre-sentencing investigation report on a dui charge?
If a prior out of state DUI is discovered by the probation department during a PSI can a defendant change plea from guilty to not guilty? In other words if a a plea bargain is reached with the DA and priors are later found during PSI will that negate the plea bargain and allow defendant to change plea to not guilty? Is there any way to avoid the PSI?
Not sure what you mean by "avoid the psi.". Do you mean avoid the discovery of the prior? the recommended penalty in...
