How hard is to get a DUI charge dismissed by claiming there was no probable cause for an arrest?
By probable cause, I mean the standard of evidence needed for a DUI arrest. The officer claims I had slurred speech, bloodshot eyes, a strong odor of alcohol, an unsteady gait, that I stumbled when I exited my car, and that I was going to fall down, but that she prevented me from doing so. I subpoenaed the body-worn camera and the dashcam footage from the patrol car and none of her claims were true. The only two possible accusations that could possibly be true are that I had a strong odor of alcohol on my breath and that I had bloodshot eyes, but I have reason to doubt those claims. That's because I brushed my teeth before driving and the street lamps were emitting a red-orangish color, so of course, that's going to make my eyes appear bloodshot. There was no bad driving, I got pulled over for driving without headlights and I didn't take any FST's or blow into the PAS device. My question is, considering the circumstances of the arrest, is it possible to dismiss the DUI charge because of the lack of probable cause for an arrest. I have a legal studies degree from UC Berkeley, so I was hoping to show the DA and the DMV that the officer lied and convince them not to file charges.

I just got a dui. Unfortunatley it is my second one in 10 yers. No accident or injuries. Filed as a misdemeanor. If I hire an attorney, will that attorney be able to appear on my behalf in court so I am free to work. I was driving down Beach Blvd going to the beach when all of a sudden I got pulled over. The officers stated that someone called because I was driving erratically -.- which I wasn't! I was throwing flowers out my car not towards anyone but to the ground it was a"He loves me he loves me not" type thing (he don't love me lol) Anyways I had about $10 worth of marijuana on my possession they did the tests on me which I personally think I did ok on. I told the officers last time I smoked was about 2-3 hrs prior to driving while I was at home (smoked about 3 hits & took a nap, woke up & planned on seeing a sunset at the beach) I was arrested & had my car impounded. This was back in May 2017. I was ordered to go to court in July & when I went I was told no paperwork had been filed. Now fastforward to the start of Nov. & I called the D.A office. I'll probably be seen in court in January 2018. I just want this nightmare over I lost my job & haven't been able to find work for a couple months now and am depressed. y case has nothing to do with alcohol 0.00% were my lab results just a case of having pot. Since I have no money I plan to represent myself has anyone here had success with that?

Motion to suppress in dui?
I just my 1st dui. I was in a small accident, bumped my head and taken to the hospital. I was 99% unconscious the whole time. The police reports say I provided consent in the hospital somehow. I don't remember that, but thats whats in the officer reports. My attorney has been talking about a motion to suppress because of the blood draw procedures used. I know every caser is different and fact specific, but I wanted to ask other attorneys how succesful their motions have been in the last few years. I have heard that the law or cases have become a little more favorable in this area in the last few years. Thanks very much ---
