I am on felony probation for my third OwI and already had a probation violation which i was punished for when I missed a probation appointment. I was pulled over a mile from my house after dropping my 10 year old off at a birthday party ( I have not been driving otherwise) and have to appear in court in november for driving on a suspended license. I am scared to death. I have otherwise been adhering to the terms of my probation. Is there a chance she will not violate me, and should I tell her now or wait until she brings it up at my probation appointment next week? Could I be put in jail before my court date for driving on suspended? Thank You.
You are likely charged with "Driving While License Revoked," not "Suspended." Considering your overall criminal record...
What steps can you take if you plead guilty on the advice of a public defender & think you got bad advice?
I dont think the public defender did a very good job defending his client. What is the point of having an attorneys if they tell you to plead guilty.
You should discuss with another attorney. There are only a few reasons why the Court would set aside a plea. There has...
i was a passenger in a vehicle and we stoped to get some fast food, and they called on us so we saw the cop and decided to park it the lot and eat our food, so the cop pulled in next to us started asking questions and we answered them honestly, so when he asked me if i had been drinking i said yes, and then he asked how much and i told him like 3o\ or drinks probably so he gave me the Breathalyzer, and i blew a 0.00. the driver also blew 0.00 but had not been drinking. the other passangers blew a 0.02 and a 0.05, so this is my first related offence. what would you recommend saying when i appear in court
I would definately suggest pleading not guilty and hiring an experienced criminal attorney that handles such matters as...
Just seeking a little bit of clarification between the two.
Zero tolerance has a stiffer penalty for license sanctions.
Is the difference between the two simply that one involves alcohol and the other doesn't? I'm not really sure what the difference between the two is.
Zero Tolerance has a stiffer license sanction.
Someone took my car without my permission and was drunk and got in an accident? Will insurance cover me?
Myself and 2 of my buddies live together. I was sleeping and I normally allow my roomate to drive my car every now and then- like once or twice a month. Well a few days ago my rooomate took my car and apparently went drinking with his buddy. Since my roomate was really drunk he let his buddy drive (my car of course) who apparently was also drunk (barely over the legal limit) and he rear ended another car. Will my insurance company pay for the damage to my car which will likely be in the $3000 range and if the other party that was hit (apparently not hurt) can they sue me for damages to their car or any possible injury and if so would my insurance cover it? Once again, I never gave this guy I barely even know permission to drive my car.
If you have collision coverage, your car should be covered for the damage. You may have to pay a deductible though....
