If i was given a citation for a 4th degree dwi but the citation has no indication of BAC or the level i was at during the arrest
woul that allow me to challenge the case in court? or help possibly drop it to a lower sentence?
No. that is not a challenge. A complaint would indicate the charge and that it was over.08. Later police reports...
Is it legal in MN to let 1 of 3 minors just walk away after curfew and after they had been drinking?
My daughter recently got a minor at 14 and so did he other friend. However there was a third person that when the cop pulled up he asked her a question and let her go with 2 other minors kids..AFTER CURFEW!! I didnt know this til the next morning because when I had to pick my kid up from the station I asked where the other girl was because she was suppose to be in my care..and the cop looked at me and said she wasnt there at all and that he didnt see her. Now I have statements from all three kids saying she was there and that the cop let her walk away..is there anything can do?
Hello. Your post is a little unclear. I am unsure what your motive and intent are - Good Samaritan/welfare of the third...
My husband was pulled over two days ago, and spent the weekend in the county jail. He was told that he is being held there so that the judge can look at his case. Once he has done that, would he need to pay bail to be picked up? Or do the 3 nights there suffice for that bail requirement? This is his first time offense and has no other criminal history. Should he expect that his license will be suspended for 3+ months? And pay a large fine? Thank you for any assistance- S.J.
He will likely either be released before his first court date without bail, or a minimal bail will be required since it...
I was pulled over this past weekend for not stopping in the correct spot at a set of railroad tracks. I had been drinking.
When the officer came to my truck he asked me if I had been drinking I said yes. I was given field sobriety tests and was asked to take a breath test. So I complied. I blew .19 in the field and was placed under arrest. I was transported to the jail without a seatbelt, and booked. I was nothing but compliant since I had been drinking. I was told that I will lose my liscense for the period of one year. Is this true? and if so what else can I do? Is this an instance when I should get an attorney? I only have one speeding ticket on my record prior to this so just looking for some advice and pointers. Thank You
It would be a very good idea to contact a criminal defense attorney directly. At the very least they can answer many...
I've been charged with a DWI, and I'm planing to travel out of the US for H1B visa stamping. what should I do?
I was charged with a 4th degree DWI. BAC .08 and no previous offenses. I can't think of any valid challenge to the case. I think the reason for being pulled over was legal, the procedure was fine, and BAC was .08 what is my best option? go to court with "no plea", and plea a bargain, just to get if over with and resolved before I have to travel? or should I fight the case anyways with a lawyer and travel with a most likely still pending case? what documents do I need to take with me for the Visa Stamp? thank you, any advice is welcome
You should consult a criminal attorney regarding your DWI case. Due to low BAC you may have some options available....
Is it possible to get a citation for underage consumption taken off of your record? or work out a deal so it never gets on it?
The citation fine has not been paid and the person has not plead guilty yet and is 18 years old.
There are deals that can be worked out with a prosecutor which would keep this off the person's record through a...
The prosecutor sent me an offer of 15 days in jail and a thousand dollar fine, along with the mandatory chemical assessment, of course. She never once mentions probation. I know that I'm likely to be on probation, I'm just wondering if it will be supervised or not. I want to move out of state, but know I can't if I end up on supervised probation. Just trying to plan around this.
You must get permission from the court before you move and are placed on supervised probation.
