Can you get an F1 OPT STEM extension with a DWI in North Carolina?
Hi, I'm an F1 student currently on OPT. I just applied for STEM extension. I was arrested last year for DWI and released the next day. I pleaded guilty in May this year after my lawyer's recommendation and was sentenced with level 5 DWI, which is supposedly the lowest sentence there is for DWI in NC. There was one aggravating factor - BAC greater than 0.15 and 1 mitigating factor - clean driving record. As part of the conviction, my license was suspended for 1 year but I was allowed a limited driving privilege with an ignition interlock. I had already done community service and medical examination so I was not ordered to do them again. I remember my lawyer telling me that a simple DWI is not a CMT so I shouldn't have any problems with immigration but can someone please let me know if my STEM extension application can be rejected because of the DWI? I have a great job and would love continue working here. Thanks!
This question needs to be directed to an immigration attorney - preferably one in NC who you can meet with (sorry, out...

Were you charged with DUI in VA or were you charged with DWI in NC? Are you licensed in VA. or NC? Which state has...
What will be the most likely outcome for me given the charges and scenario?
I currently have two pending dui's. For the first one I had to blow at the station after refusing to blow at the time of arrest (which ended up helping) because I blew a .15 three hours later. For the second I was under the influence of alcohol (two-three drinks) and had a fender bender with another vehicle. An officer witnessed the accident and immediately arrested me. I was never asked to blow into a breathalyzer, no blood or urine tests. On the records of the incident, there is no number given for my BAC. it literally says ****. My lawyer has not been very helpful to me and is impossible to get in touch with. Will the second charge be upheld? What will a DUI with no BAC record result in? Thank you for your time.
Did you have your license back on the second DWI? This is something you really need to talk to your attorney about....
Is a job interview considered to be a work-related purpose with regards to the limited driving privilege in NC?
Hi, I currently have an ignition interlock limited driving privilege in North Carolina. At the time of my conviction for DWI, I was employed, but lost my job soon after. I have an interview scheduled in another city soon. My limited driving privilege allows me to drive for work-related purposes only. I just wanted to know if driving to an interview counts as a work-related purpose, or is it only for driving while you are employed? Thanks!
I think a pretty good argument could be made that going to your job interview IS"work-related." I wish you much...
Why do I have to pay?
I was arrest for a DWI and when I went to court the case was dismissed. I went to get my license and they said I had to pay 100$ to the courts and then I have to pay to get my license back? This is in North Carolina. I am just wondering why do I have to pay?
Your license was taken for 30 days before the case was eventually dismissed, right? You get stuck paying a civil...
Completed ignition interlock out of state, and applying for license in the new state
I was charged with a DUI in Minnesota over a year ago and have been on the ignition interlock program for a year in order to gain my full license back. A few months ago, I moved to North Carolina for my husband's job. I have been getting my car calibrated here and received a letter from the State of Minnesota today stating I completed the interlock program and can now apply for my regular license without the ignition interlock restriction listed on it. However, since I now reside in North Carolina, I plan on getting a North Carolina license instead. My question is, will I be able to get a full license here considering that on the Minnesota license I have in my purse, it states the ignition interlock restriction, even though I am actually eligible in Minnesota now for my full license?? I won't be able to make it to Minnesota to go to a DMV office there, as I now reside here in NC. I do have the letter I received from Minnesota in hand stating I am now eligible for my regular license without any restrictions.....
Your question deals with two different states and the restrictions that may be placed on a person's license after a DUI/...
Is it legal to deny a pistol purchase permit for a DWI conviction?
I was convicted of a Class 2 misdemeanor DWI in Jan. 2014. I recently applied for a pistol purchase permit after spending hours searching through NC laws about the matter and the situation the DWI put me in. It is my understanding that a CCW permit can NOT be given to somebody w/ a DWI in the past 3 years, but nowhere does it state a reason for denial of a ppp. Any help would be greatly appreciated! Also I live in Pitt County. What steps do I take to appeal this denial??
You are probably going to have to speak with a lawyer about this. First off, I've never heard of a class 2 DWI. There...
