I had a flat tire and was pulled off the road onto a private drive. As I was waiting for help to arrive, the local police pulled in behind me and smelled alcohol on me. They then contacted the state police. I was offered a sobriety test and declined. Then I was unable to complete the breathalizer due to health issues. So, they took me to the hospital for blood work and I was then free to go. My vehicle was off and pulled safely off the road. Were they permitted to stop and subsequently accuse me of DUI?

Earlier this year I was placed on non DUI ARD for False Identification charges and an underage drinking and criminal trespassing charge were Nolle Prossed. I completed Non DUI ARD in April 2014. I want to expunge it, but I have no idea how. My probation officer was no help and my Pubic Defender was no help either. I was arrested 4-7-2013 for DUI accident in which I sustained no injuries and totaled my vehicle. No other property, vehicles, or people were involved in the accident, just a tree. I refused ambulance personal. I was cuffed and transported to my local hospital for blood work. No breath or sobriety on site only blood test at the hospital. I was then transported to the local station at which point I was read my rights. It is now 5-21-2013. There were two officers that I dealt with that night. A female officer who is very new to the station was the arresting officer for the DUI, and a male officer who filed the accident report. After talking to the male officer tonight as I was concerned that I haven't received any paper work at all yet, he stated that the female officer still had not filed the DUI charge as of this point and won't be available until 5-28-2013. The male officer in our conversation this evening stated that he couldn’t speak for another officer but he stated that he always files DUI Charge within 5 days as that is the law to file DUI Charges. He also said that if he were me that he would call the chief but not until I contacted an attorney. So at this point I am wondering based on the information that I have received tonight if I can even still be charged for a DUI. It has been 44 days since the date of the incident now.
