Can a drug admission at a hospital be strong enough to be used against you in court?
A good friend of mine recently got himself into trouble. He was operating a motor vehicle while intoxicated (not on alcohol), and when he crashed (not terribly bad accident just fender bender) he was taken out of the car, cuffed, sat on the sidewalk and talked to for a bit, and then taken to a hospital. Apparently he wasn't actually arrested since when he left the hospital there was no bail and he ended up going straight home (had to have a sober ride pick him up). While he was in the hospital however, apparently he admitted to taking a drug earlier that day before the accident and it states he admitted this in a hospital document. We are wondering if this could be used against him in court to turn his charge into a DWI?
Admissions can be used against him if the city subpoenas the medical person to testify at a trial. His blood work...
Coming up on the end of my 5 Year license suspension for DWI. In Missouri I have seen that you need to file a petition?
Do I need to file a petition against the State in order to be able to get my license back or is it "time served"?
You have to file a action in court. It is not automatic. You need an attorney as well.
I got a DUI 8 years ago, do i still put it on job applications?
I got a DUI in Arkansas in 2007 and convicted in 2008. I need to know if I should put that down on a job application.
Unless there is a reason that it would be a closed record it will still appear on any criminal history ran as well as...
What is admissible as probable cause?
I have a DUI pending but the probable cause listed is my medical records from a previous hospital visit earlier in the week stating I had been drinking. Is there a time limit they have to abide by when using my medical records? Doesn't the hospital have to inform me if they've released these records to anyone?
Do you mean to ask what is admissible evidence in a probably cause hearing or would this constitute probably cause?
I got a second DWI in Missouri- what are my consequences?
I received my first dwi in April 2014. The police filed my paperwork wrong and it doesn't show up on my record. My lawyer stopped calling because he said he doesn't want to bring attention to it. I got my second DWI Saturday (May 2015) although the cop never saw me driving. My car fell into a ditch in front of my house and I was out side of the car looking at the damage. He happened to drive by as I was looking at the tire. I refused to blow and was booked and placed in a 12 hour hold. What kind of punishment are we looking at here? Jail was the worst experience of my life, I want to avoid it if possible.

Registering vehicle after DUI forfeiture in new state residence
My vehicle was forfeited in my DUI case a year ago and my car sat in my bank auction facility for 3 months. They contacted me and asked me if I wanted the car back. I asked my lawyer if I should and his reply was " if the bank is giving you your car back, I suggest doing so" I paid some fees, retrieved the vehicle and its been 60 days since I shipped it to my new home state I havent received any letters or communication from my home state. I had the vehicle shipped to my new state, so my question is, since it was a repossession title, when I register it in my new state, what will happen, if anything at all. I also will need to get it set up on interlock, reporting to my home state. I still have the original title, and the bank issued a new "secured interest" title.
It is not clear from the information what some of the issues are. A car title can be used to register the car in any...
