I got a dui in north Carolina in 2003 and got put on probation I elected to bypass probation and serve my prison term.
Since then I had gotten several DWLR to tickets, which I have just recently had handled. So I go to DMV to reinstate my license and they tell me I have to complete dwi assessment. That was part of my probation which I elected to bypass and severe my time in prison. Should I still have to do the assessment since it was part of my probation terms or should I be able to get my drivers liscense with time severed.
You may have elected to serve active time, but with a DWI conviction in NC, you're still required to have an assessment...

Am I eligible to receive a limited driving privilege for work and household maintenance?
I lost my license for getting a violation on my interlock device over a month ago. I tried to drive the morning after I had been drinking and still had alcohol in my system. I had not had so much as a warn for 4 months after the incident before I received the letter that my license was being suspended. I have not yet had the device taken out since it is paid up until next week. I was wondering if I can request a limited driving privilege from the DMV to drive to work and to the store until my license is restored. Also, how would I go about requesting this from the DMV, or would I have to go through the court system?
Your best bet would be to hire an attorney and request a hearing with DMV to appeal the revocation decision. It sounds...
What is the exact procedure for an observation period when taken in for a DUI?
I ask because I was taken in and during the observation period the officer was there sitting next to me, but didn't seem to really observe me to the point that he didn't notice a belch or indication of a possible belch nor was attentive enough to notice me slipping a foreign object out of my pocket and into my mouth right before the breathalyzer which could interfere with the breath test.
15 min observation period to watch that you don't belch, vomit or have any contaminants in your mouth that could...
What is most likely to happen with my driver's license after my drunk dad blew into my interlock device?
In 2009, I was convicted of a DWI, and I was 18 at the time. I've since completed the community service and paid the fines and I now have a Monitech interlock device installed on my car, and have had it on for about 5 months with no fail readings.
Last night while I was sleeping, my father was drinking and decided to blow into my device (he's never driven the car since we had the device put in, but has seen me operate it). He apparently wanted to see if it worked. I've been reading that I'll most likely receive something in the mail from the DMV saying they want to revoke my licence and I might have to attend a hearing. Is there any chance that I will be able to keep my license? I haven't drank any alcohol since the arrest happened in '09, and I'm really freaking out.
It will be some time before you receive anything. When you take the vehicle in for your next service appointment,...
Moved out of state, arrest warrant issued for FTA on DWLR?
While in college last year I had my license revoked after not paying an expired registration ticket in time. I took care of that, but little did I realise that you also have to pay $100 to the DMV to get your license officially re-instated. I was pulled and although the officer was able to look up the fact that I didn't have any outstanding FTA's, he said if I just went to the DMV and paid the $100 that the DA would drop the charge. Before I could get a chance to get this situated, I was in a car accident and was given another ticket for DWLR before getting the 1st one settled. Although I hired an attorney, I ended up landing a huge job w/ a new company out of WV that required me to relocate. The 60-80hr weeks caused me to forget about this & now there's a warrant. What should I do?
Call an attorney in WV to take care of the problem is one potential option. The other would be to call the clerk's...
