OWI 1st in Wi-ANY chance of judge waiving IID entirely?
I had a bac of .19. Is there ANY chance of the judge waiving the ignition interlock device (not just giving lowered fees) due to financial hardship (or any other reason)? If it's of any consequence-I'm a 37 year old business owner, single mother of a 4 year old. I have a squeaky clean record (til now). Incidentally (or not?) I haven't had a drop of alcohol since the incident-a month ago. I never was a habitual drinker (have a good "reason"for driving that night) so that wasn't an issue; just the thought of a glass of wine now makes me nauseous.
Sure, there is a chance; but frankly, not a good one. The WI DOT actually threatened to charge a judge with misconduct...
First OWI in WI, Can judge waive IID?
My bac was .19 . Through google-ing I just found out that an IID is required if bac is over .15. Is there any way a judge can (be convinced to) waive it? years ago my now ex husband was convicted of his 3rd. I wrote a letter saying I was pregnant and we couldn't afford it, and the judge waived it. (I've totally learned my lesson) Hoping to spare my 5 year old memories of mommy blowing into her breathalyzer :(
My best advice to you is too find a very accomplished DUI attorney in WI to handle your case. This is the best money...
DUI Conviction in WI. Live In South Carolina.
I lived in WI in 2000 and was arrested for DUI 3rd. I moved to SC before the issue was resolved. I have never held an SC license. I returned to Wisconsin in August, 2010 to answer for charges. . I plead “no contest”, served my jail sentence and returned to my home to South Carolina. I spoke to the SC DMV and they explained to me that they cannot issue any type of restricted license, as I am currently revoked in another state and have never had an SC license. Attorneys down here have advised me to consult an Attorney in Wisconsin. Is there any possible course of action that might enable me to get my license reinstated in any capacity or reduce the duration of the revocation? Would a sentence modification be applicable here? Thank you for your help.
There are actions that you can take. However, without knowing what the charges were exactly, and the ensuing penalties,...
What will happen with a 2nd DUI offense with a positive Delta-9-THC blood level ?
In 2009 I was charged with a DUI (Ambien) which was prescribed to me. I lost my license but got it back. I was just charged with a 2nd offense Operating with restricted controlled substance. My blood level was 4.7 ng/ml of delta-9-THC. I am scared of going to jail please let me know what could happen. I go to court for a preliminary June 8th thank you.
Preliminary hearings are for felony cases. A second offense OWI is not a felony. Is 6/8 your initial appearance? Or...

Well, you're not going to jail, if that's what you mean. There's generally an offer provided to resolve the case. If...

If it qualifies as a motor vehicle in WI, you need a license in order to operate it legally. While there may be an...
