OVI conviction 2 years after OVI and Child endangerment plea to reckless opp with conditions. Do I lose plea deal??
I just plead guilty to an OVI in Clark county. 2 years ago I had an OVI and Child endangerment reduced to reckless opp. with conditions of "NO FUTURE SIMILAR VIOLATIONS FOR 3 YRS,JAIL DAYS ARE WITH NO GOOD TIME, NO ALCOHOL RELATED VIOLATIONS 3YRS" in Greene county. Do I need to hire an attorney to the event Greene County comes after me for violation of the deal??
Yes. They will violate you in Greene and can impose any and all jail time that the court suspended. Call a lawyer....
I recently was charged with OVI, OVI Refusal, OVI State and Marked Lanes. I have a pretrial next month.
Earlier this year I took a plea deal on another OVI arrest and was given Reckless Operation with special conditions. No Future similar violations for 3 years, Jail time suspended and No Alcohol related violations within 3 years. Am I at risk of them reversing the plea deal due to this new charge?
They most likely can't undue the deal but can reimpose the suspended jail time and you are at a much higher likelihood...
Will the current arrest date or conviction date determine the time period between my DUI's?
Does the arrest date or conviction date determine the amount of time between DUI convictions. Asked 23 minutes ago - Springfield, OH DUI My last DUI was in Ohio on June 14, 2004. My current one happened on May 25th, 2014 and my first court date is July 22, 2014. My current case is in Maine where I believe ten years is the cut-off for considering past convictions during sentencing. So whether it is the arrest date or conviction date could make a big difference in what happens to me.
Time goes from the date of CONVICTION on the first offense until the date of the OFFENSE for the new one. So the two...

OVI in broken down car and no proof that I was driving?
My car broke down after having some drinks and it was parked on the side of the road. I had called AAA and was waiting for family to arrive to assist me. The police pulled in front of me and never attemped to stop me or anything as my car was immobilized and parked. The car was NOT running and there is no certainty if the keys were in the ignition or not because my uncle says he arrived first and had them in his possession. I was taken to the station and blew a .16 BAC and charged with OVI, receiving the administrative suspension by the officer and a court date for this week. I'm seriously thinking of fighting the charges and make them prove I was driving. I'm looking for a physical control charge or similar if this is possible in my case? This is my very first offense.
If you want to fight the charge, you should retain a lawyer ASAP. There are always ways to fight a DUI charge, but...
Do I need an attorney for my first time OVI offence? I blew a 0.089, I am 20 years old and I was never read my Rights.
I was driving home with some friends from a casual party. It was about 2AM when we were on our way back home. I only had 3 beers and did not feel impaired whatsoever and nor we're my passengers. We get on a road close to my house, when a deer darts out into my line of vision. I panic and pull my emergency break, and I slide all the way into a telephone pole. My friends were in a panicked state and started to walk home. The car wouldn't start so I went home to tell my father about the accident. We went back to the crash site immediately to find a cop taking pictures. In short he arrested me after a sobriety test,(I passed) saying my eyes were twitching. He never read me my rights before he cuffed and questioned me. He never told me my chemical test rights and the breathalyzer looked ancient
