If this case is 7 years old, there probably isn't anything you can do. You should have gone to court and raised that...
I have two DUI convictions, one "attempted DUI" from FL(no fingerprinting done) and my last in 2008 in NJ. I have since sobered up(had a serious problem) and have gone to counseling and meetings since then, thankfully. My father has been naturalized for several years now and is urging me to get naturalized as well but I'm very worried that my past will prevent me from becoming a US citizen. Do I have any chance? And what to do I need to provide if I get to an interview? None of these involved damage to people or property.
This is not actually a dui question but an immigration question. I will change the practice area for you to immigration...
I really dont have much to spend, will it really be worth it to get a lawyer over a public defender? It is my first offense and I also have a reckless driving ticket as well.
First of all, you didn't have a BAC of 1.5, or else you would be dead. Perhaps a .15, but not a 1.5. As for "it is...
I received a DUI charge in NJ (.1) in September 2012. I was working and living in NYC with a demanding job. I pushed the court case for months through letters to the judge. I would recurve a new court date in the mail. I did not see that the last date was not rescheduled and issued a warrant. I let it go for this long. Last November my license expired as well. I have a work trip in two Chicago. I need to fix this. I let this go on because I had been driving to work for so long and now this will affect so much more. What do I do ?
YOu've put yourself in a tough spot. Your only option is to hire a lawyer and deal with the DUI charge. You will not be...
I had a past DUI, which is over ten years ago, and I also have had a past identity theft, that I was not given oppurtunity to prove. In the interim, NJMVC explained to me that I have a suspended license due to surcharges in the amount of almost 23,000! I was blown away by that amount and wanted to know if there is a way to have them reduced if I pay off all the other fees (ie. restoration fee and alcohol fee). I was told that there is a mandatory minimum required (of $1123.) if I want to start a payment plan. I dont want to pay that until i see if i can get the total amount reduced first, if possible. please help!
You have asked this question under the banner of DWI. But the DWI surcharge is $1,000 for 3 years. So obviously, if...
I was arrested for a DWI in Elizabeth NJ. My friends and I were outside of the car discussing who was going to drive when the police came up to us and started asking us questions. I was completely drunk however I was not driving. I was with 3 other women and one of them was the driver. The officers asked whos car it was and it was mine but they never asked who was driving. I was asked if i had been drinking and i told him yes. He proceeded to give me a field sobriety test. I began to argue with him because I was being accused of something I hadn't done. He proceeded to arrest me for DWI. I have witnesses stating I wasn't driving and I plan on using it in court. I can't afford a lawyer so this is all I have.
Any witnesses you intend to rely on must appear and testify in Court. A signed Affidavit probably will not be usable....
No drugs or alcohol in my system I was charged with 4 counts including dui and reckless with no law enforcement present. It was seen by civilians all firmly concluding I was 100% in the right. An hour after the incident speaking to a dozen police and medical personelle left unsupervised over 30 minutes a cop decides he had probable cause since I had my head down and a dry mouth. The only reason they conclude charging after passing 3 breath tests their DRE decided my pupils were not dilating properly after 6 checks. I had prescription medication with me that they felt impaired my driving. I gave a urine sample but how could they conclude that it was taken before or after the accident regardless of the fact that I had not taken any that day?
All facts need to be reviewed in this case to provide an accurate answer. You should definitely hire counsel for this...
