Why doesn't my personal injury lawyer want to be present at dui preliminary? Testifying as witness - victim
My lawyer knows of the hearing, but doesn't feel she needs to be there.. is this normal? I thought the point of having legal representation was to be represented?
Likely because it won't be helpful with respect to settling your claim
I will ask for a DUI public defender . Will I be asked any other questions besides the ones determining my eligibility?
Should I be prepared for any questioning besides eligibility for a public defender or the second court date will be scheduled for that purpose?
Every attorney is different. A good attorney should talk to you about your case. Some attorneys don't talk to you. With...
Will only have 9 of 11 community service days completed by my court date for DUI. What's gonna happen to me?
I was convicted of a DUI 02/14/2014, i have completed the 3 month alcohol program, IID Device, and only need to pay the fine which was converted to community service at my request. I regret doing that as I was busy going to work and going to school. I'm on my final extension and finally got some time off from work but i will only have completed only 9 of 11 days. What will happen to me on my next court date? Will i get arrested, have my license suspended, or will i be given a chance to repay whatever days are left? Or should i skip my court date and show up when all my days are done? Your help would be appreciated.
DO NOT skip your court date--that's a terrible idea!! You've completed 9 of 11 days? That's far better than most....
WHAT CAN I BE CHARGED WITH IF I VIOLATED MY SUMMARY PROBATION, AND OBTAIN A DUI OF A .1?
THE PRIOR CASE WAS FOR A DRY RECKLESS , FOR FALLING ASLEEP ON THE WHEEL, FINAL RESULT FROM JUDGE WAS DRY RECKLESS , 26 AA MEETING ( 0 DONE ) , AND A FINE WITH 2 YEARS SUMMARY PROBATION. MY LICENSE WAS NEVER TAKEN AWAY, SO IM ASSUMING THIS IS MY FIRST, DUI OFFENSE. RECENT CASES WAS A DUI ACCIDENT INVOLVING JUST MY CAR AND THE SIDEWALK AND LIGHT POST. I WAS MAKING A RIGHT OUT THE PARKING LOT AFTER A DRINK AND FROM THE OTHER SIDE OF MY DESALINATED LANE A CAR WAS ALSO MAKING A LEFT, BUT WAS APPROACHING MY LANE, SO I AVOIDED FROM BEING HIT BY THE DRUNK AND GOT FORCED TO DRIVE UP THE CURB, HITTING THE LIGHT POST. DURING THE SCENE NO BREATHALYZER TEST WAS PROVIDED BUT A PHYSICAL TEST OF BALANCE AND SOBERNESS WAS PROVIDED AND WAS TAKEN AT THE STATION, AN HOUR LATER AFTER QUESTIONING. BLEW A .1.
You'll likely be charged with a DUI, and you're facing a probation violation on the dry reckless conviction. Contact a...
Is it possible to expunge two DUI's?
About five years ago I was convicted of my second DUI and 3 years prior to that my first. I have completed all court order requirements and paid all my fines. I was wondering if it is possible to expunge these two DUI's? This is for employment purposes. Any advice will help. (Both DUI's were out of San Bernardino County)
I am assuming that both DUIs were misdemeanors? California does not have a true expungement statute. You could file a...
Should I hire private attorney, public defender has changed?
Well I was arrested for DUI back in June 2013. At my first court appearance a public defender was there to help me out. He told me the basics about my case and explained how i might have a chance since i blew a .09. Since my first court appearance there have been three other dates and on my last court date the public defender called me that the results from the lab haven't gotten back yet and he also told me that he was going to assign a different public defender. I was wondering if it's worth the trouble of actually hiring a private attorney instead. I've come to realize that this DUI is really going to set me back if it isn't reduced or thrown out. My next court date is in three weeks should i now hire an attorney.
What do you mean lab results aren't in yet? If not, then how are you sure of what the BAC level is? As for whether...
Should I hire an attorney for my DUI case. I just barely started working again. Chances it gets reduced to reckless driving.
So i was arrested for dui on the 22nd of June in Monrovia California. I'm guessing that I was pulled over for having a messed up third brake light. Anyways, I passed all the sobriety test without any difficulties and the officer seemed unsure as to whether to take me in. Then I took the Breathalyzer, the first time i blew the officer said i blew a .09. He waited a few minutes and i blew again, and shortly after i was placed under arrest for dui. He took me to the hospital so that they can draw blood, at least an hour passed before they finally drew the blood. On the way to the hospital the supervising officer said that in my case there was a good chance my dui will get reduced to reckless driving.
You should at least use the public defender if you don't hire your own lawyer - a .09% is barely above the limit and...
