How much time does a court have to request an appearance prior to the end of a DWI Conditional Discharge period?
I have been on Conditional Discharge since 12/03/15 for a DWI. On 01/01/15, I received a violation on my Ignition Interlock Device for a .07 BAC after only having the device for two weeks due to using mouthwash subsequently to chewing tobacco. I am now approximately 11 business days from the end of my Conditional Discharge (12/03/16) and have yet to hear anything from the court, with the monitoring agency informing me my jurisdiction rarely addresses single IID violations. What is the latest the court could possibly contact me and still have the ability to revoke/modify the CD? Correction: Violation was on 01/01/16*
It was not a violation of your CD. In fact, you should have petitioned the Court to get the IID removed after 6 months.
How much jail time would I get from a first offense with a dwi?
I got arrested on tuesday night wednesday morning for a dwi because my chemical test said my blood alcohol content was 1.1 but I was bleeding in my mouth. How long would I go to jail for that or what do I do to save myself from jail time?
The least of your problem is jail time. a DWI conviction can literally ruin your life. You really need to spend the...

How should I go about this notice from the office of special counsel in Albany?
I received an order of revocation of my approval as a Point and Insurance Reduction Program Instructor through the DMV, via the special counsel located in Albany. I was not present for the alleged charges which resulted in revocation. I don't care about the revocation itself because I found a good job a long time ago in my field. All I did was sign up to be certified as an instructor. I never taught a class or did any of the claims on this notice, but am in violation of teaching a class that did not fulfill the required 320 minute time-frame and falsifying class info. The defensive driving course company is owned by a family friend who knows I did nothing wrong. There is no charge on the notice except a revocation of my certification as a driving instructor. But, I need to know if this will show up on my record, including a background check, because I have aspirations to work for the government. What type of lawyer could help with this matter? And do I have anything to worry about considering I'm not even a driving instructor.. ? Again, no charges are formed against me except notice of a revocation of my instruction certificate. Please help.
Without reviewing the revocation notice and any other info you may have, no one can give you a legal opinion. However,...
What post-sentence relief can be pursued?
Son was restored to probation and ordered to attend a drug program for marijuana use after being violated for not reporting and arrested for driving with a suspended license. In a recent court appearance the Judge resentencing him to 6 months to jail because the program reported him positive for marijuana and he received a desk ticket for possession of marijuana because a friend, not him was observed rolling a joint while sitting in his car. The Friend submitted an affidavit stating it was him with the marijuana as the cops saw him rolling it, but gave the ticket to my son instead. The Judge said the affidavit can be used to address the desk ticket but he was being resentenced because of the 3 positive tests for marijuana. Days after he was sentenced the program called to find out where he was, I told them he was resentenced because of the positive urine tests. They advised me all the urine tests were light positive meaning residual marijuana still in his system from the time he started the program and not a recurrence of new Marijuana use as the THC levels were very low. What can be done to get him out of jail and before the Nassau County Judge that sentenced him?
Call the attorney who represented him ASAP and get a letter from the treatment facility. It could be that the 4 months...
