Are there previous examples of prescriptions such as Adderall effecting field sobriety tests?
I received a DWI based on the officer's observations of a field sobriety test that included a (1) the horizontal gaze test while in the automobile, (2) a walk and turn test, (3) the horizontal gaze test outside the automobile, and (4) an onsite breathalyzer (.129). I refused the chemical test and have a refusal hearing with the DMV regarding my suspended license. Is there any examples where prescriptions such as adderall have been found to effect the outcome of either the horizontal gaze test and/or Breathalyzer?

I am a 29 yr old software engineer. This is my first offense, I refused the breathalyzer. There was no accident involved and I was pulled over in front of my apartment. I rolled through a stop sign. In retrospect I wish I had blown, because I was not all that intoxicated. I have been to court and the DA offered 3 years of probation, which I turned down. I received a very good drug/alcohol evaluation and have put together 18 character letters from a pastor, my boss, co workers, and friends/family. My lawyer is going to negotiate with the supervisor DA. Does anyone know what my chances are at a conditional discharge? What about the chances of winning in court? I have 3 witnesses - 2 at the bar and my landlord who witnessed field sob tests. He is ex NYPD but is now a felon. Ty!

Will a NY Interlock Device restriction/requirement apply to me if I move to FL for work?
I plead guilty to DWAI (down from DWI) in NY. The DA asked the court to assess an Interlock requirement for 1 year, a Conditional License for 90 days, participation in the 7 week, 16 hour Impaired Driver Program and a $750 fine. I am likely moving to FL for work and was curious as to whether the Interlock requirement will follow me. I'm not looking to drink and drive obviously, but rather, I am concerned that the Interlock requirement will wipe-out my future job opportunity (local government position that requires a very significant amount of time behind the wheel). So basically, will FL be able to see that the Interlock is required in NY, and will they enforce/require that same requirement in FL? Thank you. In case it matters, this is my only issue with the law. Other than this, my only other violation was an HOV Lane ticket in 2001.

How do I get my car out of forfeiture hearing after DWI arrest in Long Island?
I was arrested for DWI in Nassau county. No accident and it's my first offense. I blew .14. The DA is trying to keep my car. Is the da successful in these hearings?
