I was convicted of a 3rd DUI offense and am currently appealing the decision. I received notice that I am scheduled to attend the IDRC's 48 hr class. Is it possible to suspend that part of my sentence until my appeal is heard in court?
Unless sentence is stayed, yes.
and is it considered a regular misdemeanor or a significant misdemeanor? i live in the state of new jersey
DWI in NJ is not a criminal offense and we do not use the language of misdemeanors either. Without knowing how your...
I need help I had three devices sent to me within a month because it was defected. I need to know how I can get away from this company without being penalized, and I have asthma its so hard to blow in that device. I don't drink and the machine keep failing me. then 5 minutes later it passes me. but the company charges every time the machine gives a test fail response. what can I do this machine is set up for people to fail, for no reason at all. this was my 1st offense and will never happen again. but I cant continue with this machine or the company
This is a new issue to my knowledge. This was ordered by the court. So a motion for relief could be filed with that...
I was pulled over for blowing a stop sign and cop thought I was intoxicated. I did the road side tests and blew into the machine registering 0.0. Cop then asked me to give a urine sample because he thought I was high. I refused. Cop ticketed me with a refusal and running stop sign. Am I obligated to give a urine sample like I would have been obligated to blow into the machine?
No, the Implied Consent Statute does not apply to urine samples - only "samples of … breath." N.J.S. 39:4-50.2(a)...
I live in New Jersey and this is a hypothetical question. I am asking if there are penalties if, after being pulled over by an officer who suspects that I am driving while intoxicated, I refuse to take the *roadside* preliminary breath and field sobriety tests. I understand that you are required to take the test on the machine at the police station. I need to know what happens, aside from most likely being arrested, if I say "I will not take the PBT or FST but will comply by blowing into the stationary machine at the precinct or give a blood sample." I know about implied consent, but most resources are unclear and do not distinguish between the roadside preliminary breath test and the breathalyzer at the police station. Thanks!
The worst that can happen when refusing to take standardized field sobriety tests is that it can be used to infer...
I'm a driver with this company for a year. I took a truck that was not on my sheet, I was told I was being insubordinate and suspended from work. I drove the truck all of a mile then returned it when Ck engine light came on. This is fine but my manager just got a DUI and he did not receive any sort of suspension. Is it considered discrimination? I reported that my manager has been abusing company time then this happened. What can I do?
The general answer to your question presents insubordination on your part and a valid reason for your suspense. Your...
My son was a first time DWI offender with over .15 blood alcohol level. He was required to put in an ignition interlock device 6 months prior to license renewal. The device was installed but now we have a problem. He cannot get insurance on the vehicle because as the owner of the vehicle the insurance company will not insure the vehicle without the owner having a license. So the insurance company is recommending to turn in the vehicle plates and registration. But the interlock device has to be recalibrated every 60 days and you have to drive the car to get it recalibrated even if you are not using the car. What can be done about this mess.
Answer: If possible, have him sell the vehicle to you or someone else, with a new title and registration being issued...
