I HAVE A SENTENCING ON 11/25/13 ON SOME PROBATION MISDEMEANOR VIOLATIONS THAT I PLEADED GUILTY TO VIOLATIONS ARE: 1.) TWO MISSED PROBATION DATES FROM LAST YEAR DECEMBER 2012 2.) LEAVING THE STATE WITHOUT PERMISSION 3.) DRIVING WITHOUT A LICENSE MY ATTORNEY IS GOING TO DO A PRE SENTENCE MEMORANDUM FOR THE JUDGE EXPLAINING THAT I A.)HAVE NO PRIORS OF ANYTHING , B.)I HAVE 2 CHILDREN , C.)SERVED 4 YEARS IN THE MILITARY , D.)AN THAT I OWN A SMALL BUSINESS THAT EMPLOYS ABOUT 12 WORKERS. MY QUESTION IS WILL THE JUDGE CONSIDER ANY OF THIS AND GIVE ME A LIGHTER SENTENCE OR WILL SHE GIVE ME A FULL SENTENCE NO MATTER WHAT I'VE DONE WITH MY LIFE AND WHAT I CURRENTLY AM DOING.

i have a sentence on 11/25/13 on multiple misdemeanor violations that i plead guilty to they are: 1.) two missed probation dates from last year 2012 2.) leaving the state without permission 3.) missing a date due to being out of state my attorney never got a commit to sentence before i plead guilty. 2 arrests in lackawanna (1 in march) & (1 in july) for driving a motor vehicle without a license(keep in mind was NOT drinking & driving) got bailed out AND GOT re -arrested in buffalo 2x's for the arrests that happened in lackawanna for violation of the probation(because its a buffalo probation) got bailed out there.Now i have 2 court cases going on 1 in lackawanna for driving with out the license in which they combined into 1 case & the 2 arrests in buffalo are also now combined to 1 case. I know its kinda confusing but i do own my own business & when both arrests happened i was locked up for a total of 13 days(6days the 1st arrest & 7 days the 2nd arrest) & it killed my business. what do you think the outcome will be. PROBATION put in the requestto stop probation and wants me locked up
Lets be frank- it sounds like your going to keep driving no matter what, and that is why probation wants you locked up....

Will I go to jail for 1st offense DWI misdemeanor with a DWAI prior in the last two (2) years? Is probation likely?
My lawyer likes to stay optimistic and not make any assumptions until the case is over, which I appreciate. I understand that no judge is the same, no county is the same, and no case is the same, but I would like to hear your opinions and experiences. Probation sounds almost like a worse sentence than jail, 3 mandatory years not being able to leave the county would make it very difficult in my career. If I am found guilty do I have any chance at getting unconditional or conditional discharge instead? I do not have an alcohol problem, I rarely drink, but I have an obvious decision making problem by having this happen to me for a second time. I am taking alcohol counseling to show that I am serious about never letting this happen again. What are your cases usually like? No accident/injury.
