I was driving home after a night of drinking, My car broke down on the way home and a deputy stopped behind me to see what was wrong. i told him the battery was not charging and that my father was on his way to help me. After a few minutes the deputy came back and asked if my father was still coming. He then said have you been drinking. I told him i had a few drinks the night before and i had just woken up(7:30am) And that my father was almost here to help me get the car back home. The officer then did an eye test which i Failed with a 5. He then went back to his car then back to my car and asked me to get out of the vehicle. I took the line test and the Balance test. I Passed the balance test and he didn't say on the line test. Was booked for DUI Blew .165. What defense should i use?

Blood results are also inconsistent, Dept. of Trans just shows my ADD med, while the prosecution shows a benzo..... I'm prescribed both and they also found the meds in my purse on which they then hung their hat on & arrested me., But I WAS NOT under the influence of anything! Do I need an interlock device with a withheld judgment on a felony DUI charge?
I was charged with a third DUI in 10 years (first two were in a different state, this was my first in Idaho). The judge granted me a withheld judgment and I have since made some major lifestyle changes. My PO has submitted paperwork for early termination we're waiting on the court's decision. I have completed three of seven years and my PO thinks I am ready to move on with my life.
After three years court-ordered suspension, Idaho DMV has fully reinstated my license. They say there is no instruction from the court for me to have an IID installed, and my PO even says that he can't find anything stating I need one. My sentencing included three years suspended license, with one year absolute. My concern is that Idaho law states that any subsequent DUI conviction requires an IID. In my case, there was never a conviction since I was granted a withheld judgment, and it was my first DUI in the state of Idaho. Do these factors play into why I may not need the IID? I have my physical license in hand now, so I'm clear with the DMV, and with my PO. But I've been doing so well and I don't want to screw up based on a technicality that may or may not apply to me.

I got a DWAI in Colorado and am required to have an interlock for 2 years.
After one year (02/2016) I have moved to Idaho.
I turned in my Colorado license which had an interlock restriction and Idaho issued me a NON-Restricted license.
