Will Juvenile Record Influence Consequence and What to Expect out of Underage Drinking Case
So, two days ago now I was issued a criminal complaint for underaged drinking. I am scheduled to go to court on June 16th and I am now 18 years old. Additionally, last year (when I was 17) I was arrested for drug paraphernalia. I completed diversion and had that sealed and nullified. However, now that I will again be in the legal system, will my past juvenile record influence the consequences? Should I expect jail time? If not, what fine should I expect and should I expect community service? Additionally, seeing as I was intoxicated, I wasn't completely sure of what story I was telling the officer about how I obtained the alcohol. I feel that my best bet is to exercise my right to the 5th amendment and avoid any trouble that could bring up. Thank you
Thank you for your question. This is serious and I would not go at it alone. Find a local attorney who will protect...

Is it posssible to avoid jail time from a first degree misdemeanor?
I am being charged with furnishing alcohol to a minor and letting the minor drink alcohol. She snook out of her house past curfew without her parents consent and I am 19 year old student. This is my very first offense ever, I am a college student, and have a clean record. Is it possible to get into the diversion program with the help of a lawyer? Thank you very much!
What programs are available to you would depend heavily on circumstances and specifics, but the diversion program is a...
Our of State OVI
Was charged with first conviction OVI (refusal) in Ohio and am from a different state. Lawyer had charges reduced to Reckless Operation and successfully appealed ALS Disposition. Now guilty Reckless Operation and guilty Implied Consent are showing on home state MVR. How do I remove guilty Implied Consent from home state MVR?
If you lost your right to drive in OH for refusing, then what may be showing up on your MVR is the refusal to take a...
Is it possible to get driving privileges (for work, school) in Tennessee?
I had my license suspended in the state of Ohio for a dui conviction. My license is suspended/restricted privileges until the middle of September. I currently am allowed to drive to work and school however due to priviledges. I accepted a job offer in Tennessee and am moving there next week. Is it possible for me to have the same driving privileges (work) there as I do in Ohio? I know that I will not be able to get my license, but I would like to have the mentioned priviledges so I would be able to go to work. Thank you for any answers.
I find that most Courts in Ohio list the place and hours of employment on the order permitting driving privileges. If...
Do you think I should take the deal from DUI to physical control?
I am an international student in Cleveland I was convicted with DUI on January 1st in Columbus so after the 2nd court trail we have a deal of 'physical control' and three day class for non alcoholic related, we kept the deal on table and trying the jury trail on March 26th so do you think I need to take the deal or fight back till it goes off record. I want to know in a long run if I want to change my visa From F1 to H1 in future would affect it or in my employement.
I cannot speak to the immigration issues. It sounds like you may have an attorney for the DUI. That is the attorney...
How many vials of blood are required to be drawn in an OVI blood draw?
I was arrested for OVI on 9/4/15 and the officer offered me a blood, breath or urine sample, and I chose to provide a blood sample. The officer took me to the hospital where the nurse drew ONE vial of blood, the officer put it in an evidence bag and we left. He cited me for OVI and then released me. He received the results on 10/13/15 and he filed charges on 10/14/15. How can I possible obtain an untainted sample? There is only one vile of blood, and the crime lab had to use it to test it. Shouldn't the officer have directed the nurse to draw 2 vials of blood so that one vile was preserved for the defense? is there enough prejudice to have the results thrown out?
As long as the original vile has been preserved, you can still require independent testing. There are strict...
