Am I able to fight what I think is an "unreasonable" public intoxication arrest?
After a night at the bar, my friends and I went to Whataburger. There were too many people to place orders in the drive through so I got out and placed my order inside. When I look outside I find my friends have forgotten and went home. I then sat inside and ate my meal while calling my friends to come get a ride. My roommate finally answers and says that he will be there in 30-45 minutes. So I continue eating. It was 4am and I was tired and ready for bed; I fell asleep at a booth. Then woken up by two police officers. They ask me where I am from and I say "Huntsville". They then say, "let's talk outside." Then arrest me and take me to the county jail. No breathalyzer. I was not belligerent, I was just simply waiting for a ride home. Am I going to be able to fight this?

What happens when you get pulled over drunk with 3 minor children in the car?
The woman I mention is already under investigation for a DWI with a fatality occuring while she was driving. She has several PI's all and maybe 2 or 3 more DWI's all within 2 yrs.. Will she get jail time? She really needs rehab, but will she get jail time? They have been letting her walk all this time, but with 3 kids in the car?
It sounds like this woman has had an untreated problem for a long while. She needs help to save herself and the lives/...
DWI was changed to Obst. of highway + 1 yr pretrial div, no alcohol for 1 yr, can they tell me what I can or cant do in my home
First offense, DWI was changed to Obstruction of highway + 1 yr pretrial diversion. One of the items listed on the contract was no alcohol for 1 yr. Can they legally tell me what I can or can't do in my home? Contract also states to not go upon any premises where alcohol is served. I can't go a real restaurant? Plus, my lawyer never told me what all a pretrial diversion consisted of, is this normal?
You are on diversion instead of being in jail. This is a privilege not a right but a privilege that comes with...
Is there any way to get charges dropped or changed from a DWI?
I had not slept for around 30 hours beforehand. I was driving from Virginia to California to begin my senior year of college. I bought a Four Loko and drank it at a rest stop about 30 minutes beforehand, trying to make myself more drowsy so I would be able to fall asleep easier. However, I was too anxious to fall asleep so I decided to keep driving for a bit. The cop pulled me over and I panicked. He asked where I was headed and I said I don't know (I was pretty out of it). He asked if I had been drinking and I said no. He told me to get out of the car and he asked me again if I had been drinking. I said yes. I admitted I admitted to drinking a Four Loko at a rest stop about an hour earlier. He then performed a field sobriety test on me. However, his instructions were unclear at times and when I got it wrong, he yelled at me which made me even more nervous. At some point he searched through my car and found about about a cup of Four Loko in a McDonald's cup. He also told me that the medication he found said that alcohol should not be used with them. He asked if I thought I should be driving. I said that it might be good for me to take a break for an hour or two. He took me to the s
