Can I get my DUI dismiss if police officer has not yet turn in Police report?
I was arrested for DUI a year ago and still to the date the police officer has no turn in the police report to the court house. I went to court 30 days after DUI like my ticket said to show up but they told me that they did not received a police report yet. I wan to apply for Citizenship but an immigration lawyer told me that I cant have any case pending and for me to resolve this problem first. is there a statue of limitations on this, can I hired a lawyer and have the case dismiss or due something type of deal with the prosecutor??
Yes, your best bet is to hire a lawyer to check out the statute of the DUI arrest and she/he will know what to do...
If I have a DUI and am getting a diversion will this prevent me from moving to another city in state ?
I have gotten a DUI. This is the only offense I have ever had on my record and will definitely be the last. I am well aware that I will have to pay fines, do community service, and probably complete some sort of program. All of that is no problem as I understand I was wrong. However I do want to attend school in a different city (Kansas City, Kansas). I have a diversion conference and was wondering if I would be able to leave the city while still completing the terms of my diversion, when I find out what those are. Will this prevent me from moving ?
Typically no, but you should check with your diversion officer to be certain. There might be requirements such as...
How long does a court have to charge you with a DUI that was charge wrong on ticket?
I was charged with a 2nd DUI when it was actually a 4th DUI. It was dropped in municipal court and sent to District court to charge me for a 4th DUI. Is there a time limit to how long it takes for them to charge me?
The statute of limitations for such a charge in Kansas is five years. It would be prudent to contact a local criminal...
DUI diversion revocation?
I was cited for DUI in 2015, no prior record. I completed the diversion program (1 year stint) without incident. 79 days after I had completed said diversion I received a letter in the mail stating my diversion was being revoked due to a police report in which the officer states I was a witness to an event at a bar. Nearly 3 years after my DUI citation and over a year after my completed diversion I am attending a evidentiary hearing to refute this report (innocent & was not at bar or drinking). I graduate with an MBA in December, if revoked and charged this will have extremely detrimental affects on my life, career, education etc. IF revoked am I sentenced for DUI on the spot, or will I have time to appeal evidentiary hearing, plead non-guilty to original DUI and set for trial, etc?
Review your diversion contract. I suspect it says that the prosecutor has 30, or 60, or possibly even 90 days to file a...
DUI diversion revocation evidentiary hearing
Graduate student- charged with first time DUI in 2014- no record prior. Entered into pre-trial diversion which I completed flawlessly, no failed U/A-Breathalyzer, no missed appts, my D/O concluded my case would be dismissed upon my last appt Dec 2017. In March 2016 I received a notice of revocation of my previously completed diversion. This was due to a police report nearly a year prior that named me in a group of over 18 individuals that were halted by police for being rowdy outside a bar. I was never on bar property. Infact this incident was well over 2000-ft from the bar and I had only showed up minutes before to pick up friends. After explaining to police they took my statement, license, and let me be the first to drive off with the friends I came to pick up (they ended up letting everyone go). My name was on police report, thus it flagged the prosecutor at end of diversion background check. After 18 months of prosecutor plea's my attorney has now set case for an evidentiary hearing. I am not guilty, and do not want placed back on div/charged for DUI. If judge rules against, can I appeal/ fire attorney and seek new council? Thanks.
I don't understand a couple of facts from your question. First of all, if I understand you correctly, this would...
When I am restricted to only operating vehicles with an interlock system, am I legally require to install one in my car?
I was charged with a DUI in January of 2017, was approved for diversion and had my license suspended for 30 days followed by 6 months restricted to only operating vehicles with an interlock system. Am I legally required to install one in my vehicle or can I simply choose to not drive for the 6 month period?
You are ABSOLUTELY required to have the interlock system installed, in your name, on a vehicle for the full restriction...
What should my next steps be in this process (DUI, insurance, auto loan, sr-22)?
I got a DUI in June of 2017. Blew .06, but failed field sobriety test and ultimately admitted to being under the influence of another drug -- basically talked myself into a DUI... although I may have still been charged with DUI regardless due to the fact that I hit a curb and messed up my car pretty bad. Was 18 then, am 19 now. The vehicle I drove was bought by grandfather earlier this year; after the event, he sells it back to the dealership (I don't blame him, I'm an idiot). My car insurance (State Farm) has since dropped me. I am uninsured and car-less. Currently enrolled in diversion program. Required 330days interlock device. Problem is, I can't start that 330days without having my own vehicle. Court fees, etc = can't save money to buy car outright right now, so looking at auto loans from lenders who wont turn away an older car (older car=lower rates). I should also note that my mother has an interlock device on her car, but I can't be on her insurance because she has State Farm. My questions: given that I need a vehicle ASAP, what should next steps be, in what order? And where does the SR-22 come into play in reference to getting an auto loan and auto insurance?
You can get insurance under the assigned risk program. Any insurance agent who sells auto insurance can sell you a...
