Can you legally refuse the Field Sobriety Tests in Michigan?
A topic at work keeps being brought up. Half the staff says you have no choice when it comes to taking FST's in Michigan, and the other half says you have the right to refuse. I am of the group that says to NEVER take a Field Sobriety Test because I believe it to be questioning and I have a right to counsel before questioning as well as a right to remain silent and not incriminate myself. Is there a law in Michigan that says you MUST submit to FST's? Thanks so much for helping to settle the argument. P.S. I understand being required to blow in the breathalyzer at the station, or submit blood after being arrested, so I wasnt referring to those.

I have 1 DUI charge, and was stopped a second time after my probation was over. It has been a year and a half since my arrest and I still have not been charged as far as I'm aware. What do I do next, my daughter recorded her father drunk and being abusive during visitation.
This weekend my daughter came home from her fathers. Every time she tells me he gets drunk, fights and hits his wife, and gets abusive with her. I have brought this all up in court many times. They never do anything but disregard it and give him his visitation. This weekend how ever when he started this she recorded it. You can hear yelling his wife saying he pulled her hair and tried to strangle her. He then gets in my daughters face yelling, swearing at her about me. You can tell he is drunk he starts asking her questions. He doesn't like her answers she starts crying and the other girls try to protect her. He slaps her in the arm and the phone falls and the screen is completely cracked now, the girls run up stairs to hide and you can hear the wife screaming as he is attacking her. Should I report this to CPS first? Is this enough evidence to the court to stop visitation? At least supervised visitation. Or would this even hold up in court? I am worried about my daughter I don't want him to retaliate against her because she did this if she has to go back there, if for some reason they clear this.
