How long does it take to get a judge to agree to re-open a felony DUI case?
My friend is an illegal immigrant who crossed the border when he was 8 years old in 1991. He has 2 DUIs. One is considered a misdemeanor & the other a felony. He has been working with a criminal defense lawyer since 2012 to get a judge to re-open the felony DUI case so they can fight the charge & try to get it expunged. After he clears his record, he will be working with an immigration lawyer to apply for DACA. The issue is that the criminal defense lawyer keeps putting off the court date with the judge or the judge is requesting more time to look at the case before agreeing to re-open it. My question is, is it normal to take 4 years to decide whether or not to re-open a case? Should we consider working with another criminal defense lawyer? Thank you.

Is there ever an exception to the rule of collateral attacking a previous DUI if you had a lawyer at the time?
Recently I received a 2nd DUI and want to try to collateral attack the 1st "guilty plea" DUI of 20yrs ago but was told since I had a lawyer at the time it was not an option. But due to the fact I showed up to court completely drunk, to where my lawyer advised me to not speak to the judge due to my intoxication, I am wondering if there can be a way to attack just the fact that I accepted a plea in such a state. Or is there anything I can do now 20yrs later to the lawyer still practicing for allowing me to do such a thing.
